199 <br /> <br /> <br />ORDINANCE N0. 8753 <br />An Ordinance authorizing the making of a dump tender's contract. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOU'dS: <br />Section 1. The Mayor and City Recorder of the City of Eugene be and <br />they are hereby authorized and directed to execute and deliver, on behalf <br />of the City of Eugene, that certain garbage contract with R. R. Hughes, a <br />copy of which is hereto attached and made a part of this ordinance. <br />Passed by the Common Council <br />this 26th day of October, 1942 <br />/s/ John Fields <br />City Recorder Pro Tem <br />approved by the T~Iayor this <br />28~ day of October, 1942. <br />~,. /s/ Elisha Large <br />mayor <br />THIS COItTRACT AND AGREEMETv'T, T~~ade and entered into this first day of <br />October, 1942, by and between the City of Eugene, a municipal corporation, <br />party of the first part; and Fc. R. Hughes, party of the second part; <br />V~ ITNESSETH: <br />That heretofore and on July 1, 1942 the City of Eugene entered into a <br />contract with Fi. R. Hughes as tender of the City's garbage dump, and that by <br />reason of the war emergency and certain orders of the O.P.A., it becomes neces- <br />sary to amend the contract then entered into so that from October 1, 1942 and <br />for the balance of the fiscal yea r, the contract shall be upon the follwoing <br />t erms~ <br />It is agreed between the parties that commencing October 1, 1942, and <br />terminating June 30, 1943 that the services mentioned in the original contract <br />shall be paid for by the City of Eugene ~p100.00 on the first day of October <br />1942, and $p100.00 on the first day of each succeding month throughout the <br />term of the contract. <br />It is further agreed that the City has again amended its garbage ordinances <br />providing that garbage haulers, desiring to retain edible portions of the <br />garbage for feeding purposes, may do so upon the payment of X25.00 per quarter, <br />and the City hereby agrees to pay such additional license charges to the second <br />arty, not exceeding together with the X100.00 provided for in this contract, <br />125.00 per month. <br />This modification shall be deemed a part of, and shall amend the original <br />garbage dump contract between the City of Eugene and R. R. Hughes and all <br />portions thereof not herein amended shall stand as before. <br />IN FITNESS VFHEREOF, the City of Eugene has caused these presents to be <br />executed by its Tl±tayor and Recorder pursuant to an ordinance of the Common <br />Council of said City, and the second party has hereunto subscribed his name <br />this first day of October, 1942. <br />CITY OF EUGENE, a municipal corporation <br />BY /s/ Elisha Lame <br />Executed in the Presence of : Tbiayor <br />City Recorder Pro Tem <br />Second Party <br />
