2112 <br />ORDINANCE N0. 8755 <br />An Ordinance initiating the vacation of the following described <br />premises, to-v~.it <br />That certain portion of Franklin Boulevard in the City of Eugene lying <br />between the North line of Eighth Avenue and a line extended from the <br />~ intersection of the North line of Broadway and the fiy'esterly side line <br />~ of Franklin Boulevard to the intersection of the southerly line of <br />Broadway extended easterly with the easterly side line of Franklin <br />Boulevard. <br />That certain section of Eighth Avenue in the City of Eugene lying between <br />the westerly line of the Southern Pacific Company's right of way extended <br />across said avenue and the westerly line of Franklin Boulevard. <br />That certain section of Broadway in the City of Eugene, lying between <br />the. westerly line of the Southern Pacific Company's right of way extended <br />across Broadway and the ~~esterly line of Franklin Boulevard. <br />and calling a hearing and directing that notice be given. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLO~~'S: <br />Section 1. The Common. Council of the City of Eugene hereby initiates <br />vacation proceedings on its~own authority without petition or consent of the <br />property owners, excepting as provided by statute, of the following described <br />property, to-wit: <br />That certain portion of Franklin Boulevard in the City of Eugene, lying <br />between the north line of Eighth Avenue and a line extended from the <br />intersection of the north line of Broadway and the westerly side line <br />of Franklin Boulevard to the intersection of the southerly line of <br />Broadway extended easterly with the easterly side line of Franklin <br />Boulevard. <br />That certain section of Eighth Avenue in the City of Eugene lying between <br />the westerly line of the Southern Pacific Company's right of way extended <br />across said avenue. and the westerly line of Franklin Boulevard. <br />That certain section of Broadway in the City of Eugene, lying between <br />the westerly line of the Southern Pacific Company's right of way extended <br />across Broadway and the westerly line of Franklin Boulevard. <br />Section 2. A Bearing shall be held upon the proposal to vacate the streets <br />herein provided, and said hearing shall be held on the 14th day of December, <br />1942, at the Council Chambers in the City Hall in Eugene, Oregon, at 7:30 <br />o'clock P.Tvi. of said day, at which time all persons will be hear upon ob- <br />jections or suggestions with reference to the vacation of said streets and at <br />said time the Council will provide for the said vacation of said premises or <br />deny such vacation, and in case the vacation is made will make provisions for <br />an~a damages sustained by local assessment. <br />Section 3. The City Recorder be and he is hereby required to immediately <br />publish for four consecutive weeks in a newspaper published in Eugene, Lane <br />County, Oregon, notice of the proposed vacation. Such notice shall give the <br />description of the areas to be vacated as herein set out, and state the date <br />when this ordinance was passed; the name of any petitioners petitioning for <br />said ordinance for vacation; the date when the said petition, together with <br />any objection or remonstrances which may be made in writing and Piled with <br />the City Recorder prior .to the date of said hearing will be heard and considered. <br /> <br />
