~ 2t~ 6 <br />ORDINANCE NO. 8757 <br />An Ordinance vacating the following described area, to-wit: <br />That certain protion of the 14 foot alley running east and west <br />through Block 34 of the Amended flat of Fairmount from the west <br />line of Lot 4 to the East line of Lot 12. <br />~ Also: That portion of the 14 foot alley of said Block 34, running <br />south and north between lots 10 and 11 from the south line of the <br />alley running east and west in said block to a point 230 feet <br />North from the Southerly line of said Block 34. <br />G'JHEREAS, heretofore and on the 26th day ,of October 1942, the Common Council <br />of the City of Eugene passed an Ordinance setting a hearing for December 14, 1942 <br />in the Council Chambers at which time and place protests and remonstrances could <br />be hear as to the vacation of the following premises; to-wit: <br />That certain protion of the 14 foot alley running east and west <br />through Block 34 of the Amended Flat of Fairmount from the west <br />line of Lot 4 to the East line of Lot 12. <br />~ Also: That protion of the 14 foot alley of said Block 34, running <br />south and north between lots 10 and 11 from the south line of the <br />alley running east and west in said block to a point 230 feet <br />North fPom the Southerly line of said Block 34. <br />tk?HEREAS, a hearing was held pursuant to said Ordinance in the Council Chamber <br />in the City Hall in the City of Eugene on Tvionday, Decerrlber 14, 1942, at 7:30 0' clot <br />F.T4i. and at said time the Council heard all objections, and <br />4~.TIEREAS, all persons owning property abutting upon said area have consented <br />to said vacation, it being the purpose of said vacation to enable the State High- <br />way Commission to reconstruct the entire Judkin's Point area at tYie Eastern City <br />Limits of the City of Eugene and eliminate all of the railroad crossings for the <br />safety of the traveling public of the City of Eugene, <br />Now Therefore, <br />THE CITY OF EUGETv~E DOES ORDAIN AS FOLLOVdS: <br />Section 1. The Common Council of the City of Lugene finds that due and <br />legal notice of the said hearing was published and posted as required by law; <br />that no valid objection to said vacation has been made at said hearing, or filed; <br />that the consent of the owners of the abutting property, properly acknowledged, <br />has been filed in said pz~oceeding; and that the public interest will not be <br />prejudiced by the vacation of said area. <br />Section 2. What said hearing was held on December 14, 1942, at 7:30 o'clock <br />F.TU1. in the Council Chambers of the City Hall in Eugene, Lane County, Oregon, and <br />no objections or remonstrances were made or filed. <br />Section 3. That the follwoing described areas, to-wit: <br />That certain portion of the 14 foot alley running east and west <br />through Block 34 of the Amended flat of Iairmount from the west <br />line of Lot 4 to the east line of Lot 12. <br />G Also: That pIDrtion of the 14 foot alley of said Block 34, running <br />north and south between lots 10 and 11 from the south line of the <br />alley running east and west in said block to a point 230 feet <br />north from the southerly line of said Bock 34. <br />be and the same is hereby vacated, and the area so vacated, being streets or alleys <br />
