<br />1 <br />2~3 <br />ORDINANCE 8768 <br />An Ordinance authorizing the making of a dump tenderts contract. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The Mayor and City Recorder- of the City of Eugene be and they <br />are hereby authorized and directed to execute and deliver, on behalf of the City <br />of Eugene, that certain garbage contract with R. R. Hughes, a copy of which is <br />hereto attached and made a part of this ordinance. <br />Passed by the Common Council <br />this 28th day of June, 1943. <br />/s/ John Fields <br />Recorder Pro Tem <br />Approved by the Mayor this <br />30th day of June, 1943. <br />/s/ Elisha Lame <br />Mayor <br />THIS CONTRACT AND AGREEMENT, Made and entered into this 1st day of July, A.D. <br />1943 by and between the City of Eugene, a municipal corporation, party of the <br />first part, and R. R. Hughes, party of the second part; <br />V~ITNESSETH <br />That, Whereas, the City of Eugene maintains a garbage dump on property <br />owned by the City South of the City Limit's and the second party has heretofore <br />been in charge of the same under a former contract, and the City's fascal year <br />commences on July 1, 1943, <br />Therefore, it is agreed between the parties hereto that the second party <br />shall care for the City's garbage dump in a sanitary and workmanlike manner, <br />complying with all laws and ordinances applicable thereto for a term of one year, <br />commencing July 1, 1943 and terminating June 30,-1944 and sha 11 receive therefor <br />Prom the City of Eugene y~118.75 on the first day of August, 1943 and X118.75 on <br />the first day of each succeeding month throughout the term of this contract. <br />As an additional compensation for the care of the garbage dump the City of <br />Eugene grants to the second party the exclusive right o:i salvage o.f all garbage <br />and waste material which shall be gathered in the City of Eugene, and this shall <br />constitute a property right which the second party may exercise. <br />It is further af~reed that the City has amended its garbage ordinance pro- <br />viding that garbage haulers desiring to retain edible portions of the garbage for <br />feeding purposes may do so upon payment of X25.00 per quarter, and there being <br />three garbage haulers, the City hereby agrees to pay over such additional license <br />charges to the seccna pulpy not to exccea alLOgeLner a total cor~LpensaLion oz' <br />~y143.75 per month. <br />The second party agrees to keep said garbage dump open and accessible from <br />eight o'clock in the morning until six o'clock in the afternoon of every day ex- <br />cept Sunday and that on Sundays the garbage dump shall be closed. <br />
