X248 <br />ORDINANCE 8776 <br />An Ordinance amending Ordinance No. 8764 entitled " An Ordinance <br />prohibiting dogs from running at large during the months of April, May, June, <br />July, August, and September of any year, in the City of Eugene, declaring an <br />emergency and providing penalties." which ordinance was passed by the Common <br />Council on the 22nd day of March, 1943, and approved by the Mayor on the 23rd <br />day of March, 1943. <br />VIHEREAS, heretofore the above entitled ordinance was passed prohib- <br />iting dogs from running at-large during the months of April, May, June, July, <br />August,~September• in each year, and <br />Vr1iEREAS, since the enactment of said ordinance the city, cooperating <br />with the Humane Society, has built up an organization for the care and regula- <br />tion of dogs, which organization would be largely disrupted if limited to sip <br />months in each year, the remaining six months largely undoing the work. <br />Therefore <br />THE CITY OF EUGEIv'E DOES ORDAIN AS FOLLOVdS ; <br />Section 1. That Ordinance No. 8764 entitled "An Ordinance prohibiting <br />dogs from running at large during the months of April, May, June, July, August <br />and September of any year in the City of Eugene, declaring an emergency and <br />providing penalties." passed by the Common Council on the 22nd day of March, <br />1943, and approved by the Mayor on the 23rd day of March, 1943, shall be <br />amended so that the title and sections 2, 3, and 4 shall read as follows: <br />(Title) An Ordinance prohibiting dogs from running at <br />large in any year in the City of Eugene and declaring an <br />emergency and providing penalties. <br />Section 2. It shall be unlawful in any year in the City <br />of Eugene for any owner of a dog to permit the same to run <br />upon premiss, streets, or alleys other than the property <br />of his owner., unless he shall be under leash. <br />Section 3. It shall be unlawful for any dog to run at <br />large-in the .City of Eugene at any time in the year. <br />Section 4. All Police officers of the City of Eugene and <br />any special officer appointed by the Chief of Police and <br />confirmed by the Council are hereby authorized and directed <br />to take up and impound any dog or dogs running at large in <br />the City of Eugene in any year. <br />Section 2. V~REAS, it is the opinion of the Common Council of the <br />City of Eugene that permitting dogs to run at large in the City of Eugene will <br />result in the destruction of valuable pegetation and constitute a nuisance and <br />a menace to health. <br />THEREFORE the Common Council declares it to be necessary for the peace <br />health and safety of the City of Eugene that this Ordinance take effect immed- <br />iately upon its passage by the Common Council and approval by the Mayor, and <br />it is so ordered. <br />Passed by the Common Council <br />this 27th day of September,1943. <br />Approved by the Mayor this 28th <br />day of September 1943. <br />/s/ John Fields <br />Recorder Pro Tem <br />/s/ Elisha Lame <br />Mayor <br /> <br />
