I <br />290 <br />ORDINANCE NO. 8798. <br />An Ordinance providing for the parking or tethering of horses <br />in the streets, alleys or public places of the City, pro riding <br />a penalty, and declaring an emergency. <br />THE CITY OF EUGENE DOES ORDAIN_~AS FOLLOWS: <br />Section 1.. The Chief of Police is hereby directed and authorized to <br />provide a suitable hitching rack at which horses can lbe tethered upon East <br />Park street in the City of Eugene, and horses may be parked or tethered at <br />said hitching rack without limitation of time between the hours of five oclock <br />A.M. and Eleven oclock P:M. of any day. <br />Section 2. It shall be unlawful for any person, firm or corporation <br />to park or tether any horse upon the streets of the city other than at the . <br />hitching rack at East Park street. <br />Section 3. Nothin herein contained shall be deemed to be a prohib- <br />ition against horses being upon the streets of the city so long as they are in <br />direct control of their owner or some person lawfully in charge of them. <br />Section 4. Any person, firm or corporation violating any of the pro- <br />visions of this ordinance shall, upon conviction before the Recorder or mun- <br />icipal judge, be subject to a f ine of not more than One Hundred Dollars, and <br />to the costs of the prosecution, and may be imprisoned in the City Jail one <br />day for each two dollars of the fine unpaid. <br />Section 5. ~+`dhereas, since the advent of the motor vehicle, no hitch- <br />ing racks are provided generally for the tethering of horses, and very few <br />horses are upon the streets of the City, and when tethered or parked upon the <br />streets and left standing, they constitue a menace to traffic, both foot and <br />vehicular, and commit nuisances upon sidewalks and doorways, and endanger ped- <br />estrians, and an emergency is declared to exist, and it is dellared to be imm- <br />ediately necessary i'or:?the,~preservation of the peace, health and safety of the <br />City that this ordinance take effect upon its passage by the Council and app- <br />o <br />roval by the Nlayor, and it is so ordered. <br />PASSED BY THE COMI~~ON COUNCIL <br />on this 10th day of July 1944 <br />/s/ John Field s_ <br />Recorder pro tem <br />AppROVED BY THE MAYOR THIS <br />11th day of July 1944. <br />/s/ Elisha Large <br />Mayor <br />
