3t~6 Ordinance 8810 An Ordinance to vacate certain streets and alleys in the City of Eugene. 1~aJHEREAS, The Common Council has caused the City Recorder to file in his office a certificate showing that all City liens and all taxes have been. ~• paid on the lands covered by the plat or portions thereof to be vacated, and ~ Whereas, the said proposed vacation has been submitted to sh~3 approved by the Planning Commission of the City of Eugene, therefore, THE CITY OF EtiGENE DOES ORDAIN AS FOLLOWS: Section 1. The Common Council of the City of Eugene hereby initiates vacation proceedings on its own aithority, without petition or consent of the property offers, excepting as provided by statute, of the following described I property in the City of Eugene, to-wit: Maple Avenue from the South line of 15th avenue to the south line of Plat of Victoria Heights. reserving to the City the right to enter, construct and maintain all sewers, water pipes and public utilities,. Section 2. A hearing will be held upon the proposal to vacate the street and alleys, as herein provided, and said hearing shall be held on the 26th dada of March, 1945, at the Council Chambers of the City Hall in Eugene, i Lane County Oregon at 7;30 P.M. of said day at which time all persons shall be heard upon objections or suggestions with refered to the vacation of said street and alleys, and at said time the Council will provide for the vacation o~ said premises or deny such vacation, and in case the vacation is made will made provisions for any damages sustained. i~ Section 3. The City Recorder be and he is hereby required to immediatel3 it publish for four consecutive weeks in a newspaper published in Eugene, Lane Co. Ouregon, notice of the proposed vacation. Such notice shall give the descrip- tion of the street and alleys to be vacated as herein. set out, and stated the date when this ordinance was passed; the name of any petitioners petitioning for said vacation; the date when the said petition, together with any objectio or remonstrances which may be made in writing and filed with the City Recorder ! prior to the date of said hearing will be heard and considered. Section 4. The City Recorder shall forthwith and within five days after) i the first publication of said notice, post or cause to be posted at or near eac! i of- said proposed vacation, a copy of the foregoing notice, which shall be heade 'Notice of Alley and street vacation", and which notice shall be posted in at least two conspicusus places in such proposed vacation area. i The posting and the first day of publication of such notice shall not be less than twenty-eight days before the time set for hearing.
