3t~6 <br />Ordinance 8810 <br />An Ordinance to vacate certain streets and alleys in the City of Eugene. <br />1~aJHEREAS, The Common Council has caused the City Recorder to file in <br />his office a certificate showing that all City liens and all taxes have been. <br />~• <br />paid on the lands covered by the plat or portions thereof to be vacated, and <br />~ Whereas, the said proposed vacation has been submitted to sh~3 approved <br />by the Planning Commission of the City of Eugene, therefore, <br />THE CITY OF EtiGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene hereby initiates <br />vacation proceedings on its own aithority, without petition or consent of the <br />property offers, excepting as provided by statute, of the following described <br />I <br />property in the City of Eugene, to-wit: <br />Maple Avenue from the South line of 15th avenue to <br />the south line of Plat of Victoria Heights. <br />reserving to the City the right to enter, construct and maintain all sewers, <br />water pipes and public utilities,. <br />Section 2. A hearing will be held upon the proposal to vacate the <br />street and alleys, as herein provided, and said hearing shall be held on the <br />26th dada of March, 1945, at the Council Chambers of the City Hall in Eugene, <br />i <br />Lane County Oregon at 7;30 P.M. of said day at which time all persons shall <br />be heard upon objections or suggestions with refered to the vacation of said <br />street and alleys, and at said time the Council will provide for the vacation <br />o~ said premises or deny such vacation, and in case the vacation is made will <br />made provisions for any damages sustained. <br />i~ <br />Section 3. The City Recorder be and he is hereby required to immediatel3 <br />it <br />publish for four consecutive weeks in a newspaper published in Eugene, Lane Co. <br />Ouregon, notice of the proposed vacation. Such notice shall give the descrip- <br />tion of the street and alleys to be vacated as herein. set out, and stated the <br />date when this ordinance was passed; the name of any petitioners petitioning <br />for said vacation; the date when the said petition, together with any objectio <br />or remonstrances which may be made in writing and filed with the City Recorder <br />! prior to the date of said hearing will be heard and considered. <br />Section 4. The City Recorder shall forthwith and within five days after) <br />i <br />the first publication of said notice, post or cause to be posted at or near eac! <br />i <br />of- said proposed vacation, a copy of the foregoing notice, which shall be heade <br />'Notice of Alley and street vacation", and which notice shall be posted in at <br />least two conspicusus places in such proposed vacation area. <br />i <br />The posting and the first day of publication of such notice shall not <br />be less than twenty-eight days before the time set for hearing. <br />
