315 <br /> <br />ORDINANCE NO. E~~20 <br /> <br />An Ordinance to vacate certain streets and alleys in the City <br />of Eugene. <br />WHEREAS, The Common Council has caused the City Recorder to <br />file in his office a certificate showing that all City liens and all <br />taxes have been paid on the lands covered by the plat or portions <br />thereof to be vacated, and <br />WHEREAS, the said proposed vacation has been submitted to and approved <br />by the Planning Commission of the City of Eugene, <br />Therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLO~JS: <br />Section 1. The Common Council of the City of Eugene hereby <br />initiates vacation proceedings on its own authority, without petition <br />or consent of the property owners, excepting as provided by statute, <br />of the following described property in the City of Eugene, to-wit; <br />Maple Avenue from the South line of 13th avenue to <br />the South line of Plat of ~lictoria Heights. <br />reserving yo the City the right to enter, construct and maintain all <br />sewers, water pipes and public utilities. <br />Section 2. A hearing shall be held upon the proposal to vacate <br />the streets and alleys, as herein provided, and said hearing shall be <br />held on the 14th day of May, 1945 at the Council Chambers of the City <br />Halll in Eugene, Lane County, Oregon at 7:30 o'clock P.I. of said day <br />at which time all persons will be heard upon objections or suggestions <br />with reference to the vacation of said street and alleys, and at said <br />time the Council will provide for-the vacation of said premises or d eny <br />such vacation, and in case the vacation is made will make provisions for <br />any damages sustained. <br />Section 3. The City Recorder be and he is hereby required to <br />immediately publish for four consecutive weeks in a newspaper published <br />in Eugene, Lane County, Oregon, notice of the proposed vacation. Such <br />notice shall give the description of the street and alleys to be vacated <br />as herein set out, and state the date when this ordinance was passed; <br />the name of any petitioners petitioning for said vacation; the date <br />when the said petition, together with any objection or remonstrances <br />which may be made in writing and filed with the City Recorder prior to <br /> <br />
