323 <br /> <br />ORDTNAIVTCE ATO. 8827 <br />An Ordinance vacating the f ollowing described area, to-wit: <br />Maple Avenue from the south line of 15th avenue to the south <br />line of Plat of Victoria Heights <br />?MiEREAS, Heretofore mnd on the 9th day of April, 1945, the Common Council of the <br />City of Eugene passed an' ordinance setting a hearing for Today 14, 1945, in the Council <br />Chambers at which time and place protests and remonstrances could be heard as to the <br />vacation of the following premises, to-wit: <br />_ Maple Avenue from -the South line of 15th avenue to the south <br />line of Plat of Victoria Heights. <br />WHEREAS, a hear in~.was held pursuant to sa.id~ordinance in the Council Chambers <br />in the city hall in the city of Eugene on Monday, May 14, 1945, at 7:30 o'clock P.M. <br />~ar~d at siad time the Council heard all objections, and <br />1VHEREAS, all persons owning property abutting upon said area have consented to said <br />vacation. <br />Now Therefore, <br />TtTE CITY OF EUGENE DOES ORDAIP? AS FCLLO~VS: <br />Section 1. The Common Council of the City of Eugene finds due and legal notice of <br />the said hearing was published and posted as required by law; that no valid objection to <br />said vacation has been made at said hearing, or filed; that the consent of the owners of the <br />abutting property, properly acknowledged, has been filed in said proceeding; and that, the <br />public interest will not be prejudiced by the vacation of said area. <br />Section 2. That said hearing was held on May 14, 1945, at 7:30 o'clock P.M. in the <br />Council Chambers of the City Hall in Eugene, Lane County, Oregon, and no objections or <br />remonstrances were made or filed. <br />Section 3. That the following described areas, to-wit; <br />Maple Avenue from the south line of 15th avenue to the south <br />line of Plat of Victoria Heights <br />be and the same is hereby vacated, and the area so vacated, being streets or alleys, shall <br />revert to the abutting property pursuant to the statutes of the State of Oregon, expressly <br />reserving however to the City of Eugene the right to enter upon said area and maintain, repair <br />and operate its public utilities. <br />Section 4. The Recorder be and he is hereby directed to file a certified copy of this <br />ordinance with the County Clerk of Lane County, together with a map or plat of said property, <br />and that a certified copy of the ordinance shall be filed with the County Assessor, and an <br />certified copy of the ordinance shall be filed with the County Surveyor. <br />Passed by the Common Council <br />this 14th day of May, 1945 <br />Approved by the Mwy or this <br />17th day of May, 1945• <br />~s~ John Fields <br />Recorder pro tem <br />~s~ Earl L.
