I <br />324 <br />ORDINANCE N0. 8828 <br />An Ordinance to vacate a certain alley in the City of Eugene. <br />WHEREAS, An inspection has been had of that certain alley between August and River- <br />view streets between 16th avenue and the Pacific Highway, and it is deemed by the Council <br />that the alley is of no particular value, and that it is dangerous and difficult to main- <br />tain and that it should be vacated. <br />And Whereas, the alley being a public way has no City liens, no taxes, and <br />Whereas, the said proposed vacation has been submitted to and approved by the Plann- <br />ing Commission of the City of Eugene, Therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene hereby initiates vacation pro- <br />ceedings in its own authority, without petition or consent of the property owners, excepting <br />as provided by statute, of the following described alley in the City of Eugene, to-wit: <br />Alley between August and Riverview Streets <br />be~~nreen 16th avenue and the Pacific Highway, <br />reserving to the City the right to enter, construct and maintain all sewers, water pipes <br />and public utilities. <br />Section 2. A hearing shall be held upon the proposal to vacate the alley, as herein <br />provided, and said hearing shall be held on the 9th day of July, 1915, at the Council Cham- <br />bers of the City Hall in Eugene, Lane County, Oregon at 7:30 o'clock P.I1R. of sa'_d day, <br />at which time all persons will be heard upon objections or suggestions with reference to <br />the vacation of said alley, and at said ti.,ie the Council will provide for the said ~aca~ <br />tion of said premises or deny such vacation, and in case the vacation is made will make <br />provisions for any damages sustained. <br />Section 3• The City Recorder be and he is hereby required to immediately publish <br />for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, notice <br />of the proposed vacation. Such notice shall give the description of the alley to be <br />vacated as hereinset out, and state the date when this ordinance was passed; the name of <br />any petitioners petitioning for said vacation; the date when the said petition, together <br />with any ob'~eetion or remonstrances which may be made in writing and filed with the City <br />Recorder prior to the date of said hearing will be heard and considered. <br />Section 1}. The City Recorder shall fcrthvai.th and within five days after the first <br />publication of said notice, post or cause to be posted at or near each end of said pro- <br />posed vacations a copy of the foregoing notice, which shall be headed "Notice of Alley <br />Vacation", and which notice shall be posted in at least two conspicuous plPCes in such pro- <br />posed vacation area. <br />The posting and the first day of publication of such notice shall not be less than <br />twenty-eight days before the time set for hearing. <br />Seotion 5. Whereas, the said alley constitutes public property which the City of <br />Eugene is responsible fore, and <br />4~Ihereas, the said alley is dangerous and difficult to maintain and it is to the best <br /> <br />~__ <br />
