I 324 ORDINANCE N0. 8828 An Ordinance to vacate a certain alley in the City of Eugene. WHEREAS, An inspection has been had of that certain alley between August and River- view streets between 16th avenue and the Pacific Highway, and it is deemed by the Council that the alley is of no particular value, and that it is dangerous and difficult to main- tain and that it should be vacated. And Whereas, the alley being a public way has no City liens, no taxes, and Whereas, the said proposed vacation has been submitted to and approved by the Plann- ing Commission of the City of Eugene, Therefore, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The Common Council of the City of Eugene hereby initiates vacation pro- ceedings in its own authority, without petition or consent of the property owners, excepting as provided by statute, of the following described alley in the City of Eugene, to-wit: Alley between August and Riverview Streets be~~nreen 16th avenue and the Pacific Highway, reserving to the City the right to enter, construct and maintain all sewers, water pipes and public utilities. Section 2. A hearing shall be held upon the proposal to vacate the alley, as herein provided, and said hearing shall be held on the 9th day of July, 1915, at the Council Cham- bers of the City Hall in Eugene, Lane County, Oregon at 7:30 o'clock P.I1R. of sa'_d day, at which time all persons will be heard upon objections or suggestions with reference to the vacation of said alley, and at said ti.,ie the Council will provide for the said ~aca~ tion of said premises or deny such vacation, and in case the vacation is made will make provisions for any damages sustained. Section 3• The City Recorder be and he is hereby required to immediately publish for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, notice of the proposed vacation. Such notice shall give the description of the alley to be vacated as hereinset out, and state the date when this ordinance was passed; the name of any petitioners petitioning for said vacation; the date when the said petition, together with any ob'~eetion or remonstrances which may be made in writing and filed with the City Recorder prior to the date of said hearing will be heard and considered. Section 1}. The City Recorder shall fcrthvai.th and within five days after the first publication of said notice, post or cause to be posted at or near each end of said pro- posed vacations a copy of the foregoing notice, which shall be headed "Notice of Alley Vacation", and which notice shall be posted in at least two conspicuous plPCes in such pro- posed vacation area. The posting and the first day of publication of such notice shall not be less than twenty-eight days before the time set for hearing. Seotion 5.
