I <br />3~0 <br />~ ORDINANCE N0. 8835 <br />i <br />i <br />i <br />j An ordinance vacating the following described area, to-wit; ~ <br />Alley between Augusta and Riverview street ,between 16th avenue and the <br />Pacific Highway,. <br />WHEREAS, heretofore and on the 11Fth day of May, 191.5, the Common Council of the <br />City of Eugene passed an ordinance setting a hearing for the 9th day of July, 19l~5 in the <br />Council Chambers, at which time and place protests and remonstrances could be heard as <br />to the vacation of the following premises, to-wit: <br />I <br />.Alley between Augusta and Riverview streets between 16th avenue <br />and the Pacific Highway. <br />f WHEREAS, a hearing was held pursuant to said ordinanc© in the Council Chambers <br />j <br />~ in the City Hall in the City of Eugene on Monday the 9th day of July, 1915 at 7:30 <br />k <br />o'clock P.M. and at said time the Council heard all pbjections, and <br />WHEREAS, all persons owning property abutting upon said alley proposed to be <br />vacated have consented to said vacation and have applied for said vacation, and the <br />City Planning Commission has consented to the vacation, f <br />Now, Therefore, , <br />THE C ITY OF EU GLIv'E DOES ORDAIN AS FOLLOWS s <br />Section 1. The Common Council of the City of Eugene finds that due and legal <br />notice of the said hearing was published and posted as required by law; that no valid <br />~ objection of said vacation has been made at said hearing, or filed; that the consent <br />j of the owners of the abutting property, properly acknowledged, has been filed in said <br />proceeding; and that the publis interest will not be prejudiced by the vacation of <br />said area. <br />Section 2. That said hearing was held on July 9, 19Ia.5 at 7:30 of clock P.M. in <br />the Council Chambers of the City Halp in Eugene, Lane County, Oregon and no objections <br />or remonstrances were made or filed. <br />Section 3. That the following described area, to-wit; <br />~~ Alley between Augusta and Riverview streets between 16th avenue and the Pacific Highway <br />be and the same is hereby vacated, and the area so vacated, being alleys shall revert <br />to the abutting property pursuant to the statues of the State of Oregon, reserving to <br />the City the right to enter, construct and maintain all sewers, water pipes and public <br />utilities. - <br />Section 1.~. The recorder he end he is hereby directed to file a certified copy of <br />this ordinance with the County clerk of Lane County, together with a map or plat of said <br />property and that a certified copy of the ordinance shall be filed kith the County <br />Aseessor, and another certified copy of the ordinance shall be filed with the County <br />Surveyor. <br />°ASSED BY THE COP,BPdON COIINCIL <br />THIS 9th day of July, 19+5• <br />~s/ John Fields <br />recorder <br />APPROVED BY THE MAYOR THIS <br />10th day of July, 1915. <br />~s~ Earl L_.
