<br />3~5 <br />ORDINANCE N0. 8839 <br />An Ordinance providing for water regulations, and providing a penalty for <br />failure to comply therewith, and declaring an emergency. <br />WHEREAS, the constant growth of the City has expanded the use of water for <br />irrigation and for other purposes to a point where during unusual and excessively <br />hot weather, water must be used conservatively in order to maintain adequate fire <br />protection and sanitary conditions essential to the preservation of the health of <br />the people of the city. <br />Now therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The Eugene Water Board has heretofore adopted reasonable regula- <br />tions with respect t o t her use of water for irrigation in the city providing for alter- <br />nate days of use on eacY~ side of the City. Ttie Council hereby adopts and enacts said <br />regulations and directs the water board to issue notifications to water users by mail <br />stating the regulati ons; the Council hereby setting Detober 1, 19145, as the time at <br />which such regulations shall cease and be of no further effect. <br />Section 2. It shall be unlawful for any person, firm or corporation in the <br />City of Eugene to.fail to comply with the foregoing regulation on the use of water. <br />Section 3. Any person, firm or corporation failing to observe the regulata <br />tions promulgated by the water board as hereinbefore set out, shall be deemed guilty <br />of a violation of the provisions of this ordinance and upon conviction before the <br />municipal fudge shall be fined not to exceed X100.00 and may be imprisoned one day <br />for each X2.00 of thefine unpaid. <br />Seetiaril~. Whereas, Eugene is experiencing a servers hot spell and constit- <br />uting a threat to the City's safety in the mattor of fire protection and also in the <br />matter of the health of the citizens occasioned by a water shortage, an emergency is <br />therefore declared to exist and the Council declared that it is necessary for the peace, <br />health and safety of the City of Eugene that this ordinance take effect immediately upon <br />its passage by the Council and approval by the Mayor, and it is so ordered. <br />PASSED BY THE COMt~QON COUNCIL <br />this 9th day of July, 19+5• <br />~s~ John Fields <br />recor er <br />APPROVED BY THE MAYOR THIS <br />10th day of July, 19145. <br />~s~ Earl L.
