I <br />3~6 <br /> <br />ORDINANCE N0. 881+0 <br /> <br />An ordinanace initiating the vacation of the following described premises, to-wits <br />The alley in Block 1, Cheshires 2nd Addition to Eugene described as folloPrs: <br />Beginning at the northwest corner of lot 1, block 1, Cheshires 2nd Addition running <br />thence north 11~ feet,. thence east 160 feet, to the west line of Lincoln street if <br />extended, thence south ].1~ feet, thence west 160 feet to the point of be~inring, in <br />Lane County, Oregon. <br />and calling a hearing and directing that notice be given. <br />THE CITY OF EUGEDE DOES ORDAIN 1!S FOLLO'vrS: <br />Section 1. The Common Council of the City of Eugene hereby initiates vacation <br />proceedings on its own Guth bFity without petition or consent of the property owners, <br />exceptin g as provided by statute, of the following described property, to-wit: <br />the alley in block 1, Cheshire's 2nd addition to Eugene described as follows: <br />Beginning at the northwest corner of lot 1, block 1, Cheshires 2nd addition dunning <br />thence north ].1.~ feet thence east 160 feet, to the west line of Lincoln street if <br />extended, thenco south 11.} feet, thence west 160 feet to the point of beginning, in <br />Lane County, Oregon. <br />Section 2. A he aring shall be held upon the proposal to vacate the alley as here <br />in provided, and said hearing shall be had on the 8th day of October, 191+5, at the Council <br />Chambers in the city hall in Eugene, Oregon, at 7130 o'clock P.P~. of said day, at which <br />time all persons will be heard upon objections or suggestions with reference to the <br />vacation of said alley, a:.d at said ti1i1C the CouzLcil :rill proviaa for the vacation of said <br />premises or deny such vacation, and in case the vacation of said premises is made will <br />make provisions for any damages sustained,by local assessment. <br />Section 3. The city recorder be and he is hereby required to immediately publish foz <br />four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, the <br />newspaper selected by him is hereby designated as tho official newspaper of the city for <br />this purpose, notice of proposed vacation. Such ~atice shall give the description of tie <br />-area to be vacated as herein set out, and state the date vyhen this ordinance was passed; <br />the name of any petitioners petitioning for said vacation; the date when the said petition <br />together with any objection or remonstrances which maybe made in writing and filed with <br />the city recorder prior to the date of said hearing, will be heard and considered. <br />Section 1~. The City recorder shall fortwith and within five days after the first <br />publication of said notice, post or cause to be posted at or near each end of said proposes <br />vacation, a copy of the foregoing notice which shall bo headed "Notice of Alley Vacation" <br />and which notice shall be posted in at least two conspicuous places in such proposed <br />vacation of such area. <br />The posting and the first day of publication of such notice shall not be less than <br />28 days. before the time set for hearing. <br />Passed by tho Common Council <br />this 13 day of August, 191x.5. <br />~s John Fields, Recorder <br />Approoed by the Planning Commission <br />M.
