3 ~ '7 <br />ORDINAP3CE N0. 88l~1 <br />An Ordinance initiating the vacatiion of the following described premises, to-wit; <br />Vacation of alley in block 5 Cheshire's Addition to Eugene, described as follows: <br />Beginning at the $nutheast corner of lot 8, block 5, Cheshires 1st addition to <br />Eugene, running thence south. 17 feet, thence west 1FA feet, thence north 17 feet <br />thence east 160 feet to the place of beginning in Eugene; bane County, Oregon. <br />and calling a hearing and directing that notice be given. <br />THE CITY OF EUGPJL DOES ORDAIN AS FOLLOWS: <br />Section I. The C mmon Council of the City of Eugene hereby initiates vacation <br />proceedings on its own authority without petition or consent of the property owners, <br />excepting as provided by statute, of the following described property, to-wit; <br />Vacation of alley in block 5, Cheshires 1st addition to ,Eugene, described as follows: <br />Beginning at the southeast corner of lot 8, bloom 5 Cheshires 1st addition to Eugene, <br />thence north 17 foet, thence east 1i;0 feet to the place of bc~inning in Eugene, Lane <br />County, Oregon. <br />Section 2. A hearing shall be held upon the proposal to vacate the alley as <br />herein provided, and said hearing shall be had on the 8th day of October, 19I~5, at <br />the Council Chambers in the City Hall in Eugene, Oregon at 7:30 o~clock P.M. of said day <br />at which time all persons will be reard upon objections or suggestions with reference to <br />the vacation of said alley, and at said time the Council will provide for the vacation <br />of said prum~es~~.orfdeny.>aueh~vacation, and in case the vacation of .said premises is <br />made will make provisions for any damages sustained, by local assessment. <br />Section 3. The City Recorder be and he is hereby required to immediately publish <br />for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, the <br />newspaper selected by him is hereby designated a~ the official newspaper of the city for <br />this purpose, notice of the proposed vacation. Such notice stall give the description <br />of the area to be vacated as herein set out, and state the date when this ordinance was <br />passed; the name of any petitioners petitioning for said vacation; the dato when the said <br />petition, together with any objection or remonstrances which be made in writ ing and filed <br />with the city repcrder prior to the said of said hearing, will be heard and considered. <br />Section 1.~. The City Recorder shall forthwith and within five days after the 1st <br />publication of~said notice, post or cause to be posted at or near each end of said <br />proposed vacation, a copy of the foregoing notice which shall be headed "Notice of AIley <br />vacation", and which notice shall be posted in at least two conspicuous places in such <br />proposed vacation of such area, <br />The posting and the 1st day of pui~lication at such notice shall be not less than <br />28 days before the time set for hearing. <br />Passed by the Common Council <br />this 13th day of August, 1~.5. <br />~s~ John Fields, City Recorder <br />Approved by the Planning Commission <br />Approved by the Mayor this <br />lath day of August, I;'~5. <br />~s~ Earl L.
