I <br />348 <br /> <br />ORDINANCE N0. 881+2 <br />r <br />An ordinance initiating the vacation of the following described premises, to-wit: <br />Vacation of alley from Mill street to the center of Bock 1~, Driverton <br />Addition to Eugene. <br />aad calling a hearing anal directing that notice be given. <br />Thy CITY OF EU(~TTE~ DOES ORDAIN AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene hereby initiates vacation <br />proceedings on its own authority without petition or consent of the property owners, <br />excepting as provided by statute, of the following described propet~s, to-wit: <br />Vacation of alley from Mill street to the center of Block 1.~, Driverton <br />Addition to Eugene. <br />Section 2. A hearing shall be held upon the proposal to vacate the alley as <br />henein provided, and said hearing shall ue had on the 8th day of October, 1g1.~5, at the <br />Council ChQ.xabers in the City Hall of Eugene, Oregon at 7:30 otclock P.M. of said day <br />at which time all persons will be heard upon objections or suggestions with reference to t} <br />vacation of said alley, and at siad time the Council will provide for the vacation of <br />said premises or deny such vacation, and in case the vacation of said premises is made <br />will make provisions for any damages sustained, by local assessment. <br />Section 3. The City Recorder be and he is hereby required to immediately publish <br />for four consecutive weeks in a newspaper published in Eugene, Lane CBunty, Oregon, the <br />newspaper selected by him is hereby designated as the offiaalnetivspaper of thecity for <br />this purpose, notice of the proposed vacation. Such notice shall give the description <br />of the area to be vaccted as herein set out, and state the date when this ordinance was <br />passed; the same of any petitioners petitioning for said vacation; the date when the <br />said petition, together with am y objection or remonstrances which niay be made in writing <br />and filed with the City recorder prior to the date of said hearing, will be heard and <br />considered. ~- <br />Section !~. The city recorder shall forthwith and within Five days after the 1st <br />publication of said notice, post or cause to be posted at or near each end of said <br />proposed vacation, a copy of the oferoing notice which ,shall be headed "Notice of Alley <br />Vacation", and which notice s~iall be posted in at least two conspicuous places in such <br />proposed vacation of such area. <br />The posting and the first day of publicatio-r~ cf suoh notice shall not be less <br />than ?_8 days before the time set for hearing. <br />' Passed by the Common Council <br />this ~ 13th day of August, 191x.5. <br />~s~ John Fields, City Recorder <br />A proved by the Mayor this <br />l~th day of Au~~ust, 191+5. <br />~s~ Earl L.
