3~2 <br />ORDINANCE NO 88IG6 °~f <br />~ ~~ <br />An Ordinance granting to Irish ~ ~rrartz, a corporation, the right to erect <br />a marquee across the alley in block 20, Packard's Addition to Eugene, Lane County, <br />Oregon. <br />WHEREAS Irish &; Swartz, a corporation, own store ouildings on each side of <br />the West end of the alley. in block 20 Packard's Addition and it is desired that a <br />marquee be extended from ono to the other in order to afford protection in the movement <br />of goods from one building to another, Therefore <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; <br />Section 1. The Gity of Eugene hereby grants a right and franchise unto Irish <br />& Swartz, an Oregon Corporation, to erect a marquee which shall conform to the build - <br />ing code of the City, extending across the West end of the alley in block 20 of <br />Packard~s Addition. <br />Section 2. The West margin of the marquee shall be approximately 50 feet <br />from Monroe Street, and the. marquee shall be 20::feet wide and shall have an 18 foot <br />clearance over the alley for traffic. <br />Section 3. WHEREAS the marquee yields no income other than that of eon- <br />venience to the owners, the Council expressly exempts Irish & Swartz Corporation, <br />from the payment of any compensation to the City. <br />Seotion I~. Should the City of Eugene desire to purchase, condemn or other- <br />wise acquire the marquee hereinbefore referred to the price to be paid by ttie Cit y <br />shall exclude the value of this or any franchise granted by the City connected with <br />such franchise. <br />Section 5.
