~s3` <br />ORDINANCE N~:BER 8~' ;' <br />An Ordinance vacating the following described area, to-wit: <br />The alley from Mi11 Street to the center of Block 1.~, Driverton <br />Addition to Eu:~ene. <br />Wf~REAS, heretofore and on the 13th day of August, 1945, the Common Council <br />of the City of Eugene passed an Ordinance setting a hearing for~the 8th day of October, <br />1915, in the Cozzncil Chambers, at which time and place protests and remonstrances <br />could be heard as to the vacation of the following promises, to-wits <br />The alley from Mill Street to the center of Block !~, Driverton <br />Addition to Eugene. <br />and, <br />VNHEF.EAS, a hearing was held pursuant to said Ordinance in tha Council Chambers <br />in the City Hall in the City of Eugene on Monday, the 8th day of October, 191.5, at <br />7:30 o'clock P.M. and at said time the Council heard all objections, and <br />WHEREAS, all persons owning property abutting upon said alley proposed to be <br />vacated have consented to said vacation and have applied for said vacation <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWSs <br />Section 1. The Common Council of the City of Eugene finds that due and le gal <br />notice of said hearing was published arid posted as required by law; that no valid <br />objection has been made at said hearing, or filed; that the consent of the owners <br />of the abutting property, and consent of City Planning Commission, properly acknowledged, <br />has been filed in said proceeding; and that the public interest will not be prejudiced <br />by the vacation of said portion of alley. <br />Section 2. That said hearing was held on the 8th day of October, 1915, at <br />7:30 o'clock P.M. in the Council Chambers of the City Hall in Euger_e, Lane bounty, <br />Oregon; and that all matters necessary to be done have been completed. <br />Section 3. That the fo3:laWing described area to-wits <br />The alley from Mill Street to the center of Block 1.~., Driverton <br />Addition to Eugene, <br />be and the same is hereby vacated and the area so vacated, being an alley shall revsrt <br />to the abutting property pursuant to the statutes of the State of Oregon, reserving, <br />however, to the City of Eugene the perpetual right to maintain any public utilities or <br />structures now in the street and to lay down at any time that the Counoil deems <br />necessary or convenient, any public utility in the alley, and reserving the right to <br />enter upon the alley and maintain the same. <br />Seotion ~.
