<br />An Ordinance adopting the Report of the viewers upon the proposed
<br />opening of Tyler Street between 12th Avenue West and 14th Avenue West, in the
<br />City of Eugene, Oregon.
<br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
<br />Sdcticn 1. That the report of W. R.Robertson, James A. Rodman, Sr.,
<br />and Frank Cashman, as Viewers upon the proposed opening of Tyler Street between
<br />12th Avenue West and 14th Avenue West in the City of Eugene, Lane County,
<br />Oregon, made and filed on the $ivh day of July, 1946, having been duly examined
<br />by the Common Council of said City of Eugene, and said report appearing to
<br />the to be in all respects reasonable and just, the same is hereby
<br />adopted as so made, in words and figures following to -wit:
<br />That at the time and place appointed by the Common Council for the
<br />first meeting, towit: at the Council Chambers in the City of Eugene on the
<br />24th day of June, 1946, at 9:30 o'clock a.m., the members of the Board, to -wit:
<br />W. R. Robertson, James A. Rodman, Sr., and Frank Cashman, met, took the oath
<br />of and elected W. R. Robertson as Chairman of the Board, and thereupon
<br />adjourned to view the property sought to be condemned together with the various
<br />properties extending along said proposed opening; as to the benefits and damages
<br />they would receive through the proposed opening of Tyler Street between 12th
<br />Avenue West and 14th Avenue West in the said City of Eugene, and called to
<br />their assistance the City Engineer and examined the map prepared by him, and
<br />all lots and acreages adjacer..t to the improvement, and having therefore assessed
<br />the damages that will accrue to the lands and the persons hereinafter named
<br />and described, and having assessed all special benefits that will accrue to
<br />private property in the vicinity of the proposed extension by reason of the
<br />opening and extension of said street as aforesaid, the Viewers found that the
<br />following lands will be and are taken by the extension and opening of said
<br />street and the owners thereof are damaged as shown, towit:

<br />The viewers found that there is no adjacent property to said proposed
<br />opening of said street which can be or will be benefitted by such opening and
<br />that the total damages by reason of such opening is $1,250.00, with no
<br />Specific benefits.
<br />And in the judgment of the Viewers the opening, laying out establish-
<br />ing and widening and changing of the said street as proposed is of sufficient
<br />Public benefit so that it is just and equitable in apportioning the damages
<br />assessed that the following apportionment of benefits be made against the
<br />City of Eugene to be paid out of the general fund, to -writs
<br />Total damages,
<br />$1,250.00
<br />We therefore most respectfully ask that thin repori, be adopted and
<br />that we be discharged from our duties as Viewers-; herein.
