v~3 <br />ORDINANCE N0. 8989 <br />An Ordinance amending Section Thirteen of the Ordinance No. 8113, entitled; <br />"An Ordinance to create or divide the City into <br />Districts within some of which it shall be lawful <br />and within others of which it shall be unlawful <br />to erect, construct, alter or maintain certain <br />buildings, or to carry on certain trades or callings <br />or within which the height and bulk of future build' <br />ings shall be limited, and providing for setback <br />lines, and providing for a penalty for the violation <br />thereof." <br />passed by the Common Council April 8 „ 1935, and approved by the Mayor April 9, 1935, <br />J by extending the provision as to setback lines. <br />THE CITY OF EU CEIdE DOES ORDAIN AS FOLLOWS: <br />Section 1. That Section 13 of Ordinance Pdo. 813 entitled; <br />"An Ordinance to create or divide the City into <br />Districts within some of which it shall be lawful, <br />And within others of which it shall be unlawful <br />to erect, construct, alter or maintain certain <br />buildings, or to carry on certain trades or callings, <br />or within v~rhich the height and bulk of future build- <br />ings shall be limited, and providing for setback <br />lines, and providing for a penalty for the violation <br />thereof," <br />passed by the Common Council April 8, 1935, and approved by the Mayor April 9, 1935, <br />be and the same is hereby amended so as to add the following: <br />Setback line is hereby established upon and along <br />the South side of the State of Oregon Highway right <br />of way line immediately South of Franklin Boulevard <br />from the South line of 11th Avenue East easterly to the <br />City Limits, of 52 fast, and no building or structure shall <br />be permitted nearer to said Highway right of way line than <br />as herein provided, except that the Common Council may, <br />upon application of a property owner, by special ordinance <br />or resolution temporarily change or alter the setback line <br />as to a particular property. <br />The City Engineer be and he is hereby authorized and directed to place <br />the foregoing setback line upon the Use Map of the City of Eugene and immediately <br />draft such line upon the Use District 11Iap and the said lines be and they are <br />hereby established as the setback lines from said South line of 11th Avenue East <br />easterly to the City Limits, along the South side of the State Highway right of <br />vray adjacent to Franklin Boulevard. <br />Section 2. T~VIiEREAS, buildings are being erected which are not in <br />conformity ti~rith structures already around the streets, thus greatly injuring the <br />general appearance of the city and the property rights of persons who have already <br />built, therefore an emergency is declared to exist and it is necessary for the <br />immediate preservation of the peace, health and safety of the City that this <br />Ordinance take effect immediately upon its passage by the Common Council and <br />approved by the Mayor and it is so orderod. <br />
