<br />"... <br />490 <br /> <br />ORDINANCE NO. 8916 <br /> <br />I <br /> <br />WHEREAS, Under the provisions of Ordinanoe No. 8861, entitled: <br /> <br />"An Ordinanoe regulating establishments where food and/or <br />drink is provided for consumption by the publio and repealing <br />all Ordinanoes in oonflict therewith and deolaring an emerg- <br />ency. " <br /> <br />passed by the Common Counoil on the 10th day of Deoember, 1945 and approved by the <br /> <br /> <br />Mayor on the 11th day of December 1945, provision is made by Seotion 2 for the <br /> <br />procuring of a license for restaurants from the health officer. <br /> <br />Whereas, the health officer has resigned and due to shortage of qualified <br /> <br />health personnel in the City, there will be some little delay in the appointment <br /> <br />of another health officer, Therefore, <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. That until a qualified offioer is appointed, under the pro- <br />visions of Ordinanoe No. 8861, the City Manager be and he is hereby direoted to take to his <br /> <br />aid any qualified medical advice or assistance necessary, and to himself issue licenses <br /> <br />to restaurants during such interim period. <br /> <br />Section 2. As soon as a qualified health officer is appointed, the right of <br /> <br />I <br /> <br />the City Manager to issue restaurant licenses shall oease, but all lioenses issued <br /> <br />by him. during the interval shall stand and have the same force and effect as licenses <br />issued by a duly appointed and qualified oity health officer. <br /> <br />Whereas, the operation of restaurants is being conducted without licenses <br /> <br />during 'the period that the office of the health officer has been vacan't, and it is <br /> <br />very necessary for the health of the City that restaurants be regulated and an <br /> <br />emergenoy is hereby declared to exist and it is declared to be necessary for the <br /> <br />immediate preservation of' the peace; health and safety of the city that this ordinanco <br />;: <br /> <br />take effect immediately upon its passage and approval by the Mayor, and it is hereby <br /> <br />ordered. <br /> <br />Passed by the Connnon Council <br /> <br />Approved by the Hayor this <br /> <br />8th day of July, 1946. <br /> <br />9'th day of July, 1946. <br /> <br />/s/ <br /> <br />John Fields <br /> <br />/s/ Earl L.
