<br />~~~ <br />O~DINATdCE N0. 9028 <br />An Ordinance amending Ordinance No. 81x.13 of the City of Eugene, entitled; <br />"An Ordinance to create or divide the City into Districts <br />within some of which it shall be lawful, and within others <br />of which it shall be unlawful to erect, construct, alter or <br />maintain certain buildings, or to carry on certain trades <br />or callings ow within which the height and bulk of future build- <br />j ings shall be limited; and providing for setback lines, and <br />j providing for a=penalty for the violation thereof." <br />i - <br />passed by the Common Council April $, 1935, and approved by the Mayor, April 9, 1935. <br />VVI~REAS, under the direction of the Common Council of the City of Eugene <br />t <br />the City PlA»r~rg Comn3.ssion has prepared a tentative report and held hearings thereon <br />L <br />~ and has adopted the tentative report as their final and permanent report and transmitted <br />i ~ s <br />i the same to the City Council with recommendation that the same be enacted into an Ordin~ <br />` r101'P, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOIVS : <br />Section 1. That Ordinance No. 8l.~.3, entitled; <br />i "An Ordinance to create or divide the City into Districts <br />within some of which it shall be lawful, and within others <br />of which it shall be unlawful to erect, construct, alter or <br />maintain certain buildings, or to carry on certain trades or callings, <br />or within which the height and bulk of future buildings shall <br />be limited, and providing for setback lines, and providing for <br />a penalty for the violation thereof.tt <br />passed by the Cormion Council April 8, 1935s and approved by the Mayor April 9, 1935, be <br />and the same is hereby amended in the following particulars; <br />That the classification of; <br />Lots 1 through 6; Block 32, Fairmount Amended Addition; Lots 17 <br />through 21~, Block 3t~, Fairmount Amended Addition; and the West <br />33 feet of Lot 25, Block 3L~, Fairmount Amended Addition to Eugene, Oregon, <br />be and the same is hereby designated as business classification and zoning, provided, <br />hot~rever, that a building set back line of 25 feet is hereby established upon and along <br />the Southerly boundary of said tract, and no building or structure shall be permitted <br />near to the Southerly line of said tract than as herein provided,'except the Common <br />Council may, upon application of a property owner, by special ordinance or resolution, <br />t <br />temporarily change or alter the setback line as to any particular part of said tract. <br />Section 2.
