<br /> <br />595 <br />oaDlNArrcE No. yo32 <br />An Ordinance vacating the followring described area, to-wit: <br />That part of the platted alley located between Orchard <br />and Wa3.nut Streets and extending North of 15th Avenue <br />East, lying to the North of the South Line of Lots <br />munbered 11 and 1~, in said Block, in the City of Eugene, <br />Oregon, <br />V~l3EREAS, heretofore and on the 12th day of It2ay, 19LE.7, the Com¢non Council <br />r <br />of the City of Eugene, passed an Ordinance setting a hearing for the 7.)ath day of <br />July, 191x.7, at the Council Chambers, at which time and place protests and remonstrances <br />could-be heard as to the proposed vacation of the follavring premises, to-+arit; <br />That part of the platted alley located between Orchard <br />and Walnut Streets and extending Prorth of 15th Avenue <br />East, lying to the Plorth of the South line of Lots <br />numbered 11 and L~., in said Block, in the City of Eugene, <br />Oregon. <br />and <br />WHEREAS, due notice was duly and regularly given of said hearing and a <br />hearing was held pursuant to said Ordinance in the 8ouncil Chambers of. the City vial] <br />in Eugene, on Monday, the 1l.~.th day of July, 19li.7, at 7;30 o~clock P.B~T., and at said <br />time the Council heard alI objeotions; and <br />Vi(T~REAS, all persons owning property abutting upon said alley proposed to <br />be vacated have consented to said vacation and have applied for the same. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOVIS; <br />Section 1. The Common Council of the City of Eugene finds that duo and <br />regular notice of said heaxing was published and posted as required by law and that no <br />valid objection has been. made at said hearing or filed. That the consent of the owners <br />of the abutting property has been duly and regularly filed in said proceeding and that <br />the public interest will not be prejudiced by the vacation of said portion of alley. <br />Section 2. That said hearing was held on the ]l.rth day of July, 19.7, at 7;30 <br />o~cloek P.P~., in the Council Chanters of the City Hall of Eugene, Lane County, Oregon <br />and that all matters necessary to be done in the premises have been duly and regularly <br />campleted• <br />Section 3. That the follovring described area, to-wit; <br />That part of the platted alley located between Orchard <br />and Walnut Streets and extending North of 15th Avenue <br />East, lying to the }forth of the South line of Lots <br />T~rumbered 11 and Ja., in said Block, in the City of Eugene, <br />Oregor_, <br />be and the same is hereby vacated and the area so vacated, being a portion of the <br />public alley, shall revert to the abutting property ou~mers pursuant to the statutes of <br />the State of Oregon, reserving, however, unto the City of Eugene and any of its agencies, ' <br />the perpetual right to maintain any public utility or structures now or hereafter located <br />upon and within the area vacated, and to lay doom and construct at any time the City of <br />Eugene, or any of its agencies shall deem necessary or convenient, any public utility <br />
