r~` <br />~~ <br />ORDINANCE NO. 9033 <br />r <br />An Ordinance vacating the follcr~r:ing described area, to-wit; <br />That certain platted alley between 7th and $th Avenues <br />V'Test, extending from Filmore Street to Almaden Street, <br />in the City of Eugene, Oregon except the South 1L~.feet <br />there of• <br />F <br />F S, heretofore and on the 12th day of ~iay, 19l~.7, the Common Council <br />f <br />of the City of Eugene, passed axi Ordinance setting a hearing for the ].Clth day of July, <br />' 1gI.~7, at the Council Chambers at which tuna and place protests and remonstrances could <br />be heard as to the proposed vacation of the following premises, to-~s~.t: <br />That certain platted alley between 7th and 8th Avenues <br />~4~dest, extending from F'ilmore Street to Almaden Street, <br />in the City of Eugene, Oregon, except the South ].feet <br />thereof ; <br />and, <br />1~V~REAS, due notice was duly and regularly given of said hearing and a <br />hearing was held pursuant to said Ordinance in the Council Chambers of the City Ha11 <br />in Eugene, on Monday, the l~.th day of July, 1g1~7, at 7;30 o~clock P.~d., and at said <br />i time the Council heard all objections; and <br />4 1~1HEREAS, all persons awning property abutting upon said alley proposed to <br />be vacated have consented to said vacation and have applied for the same. <br />fiHE CITY OF EUGENE DOES ORDAIN AS FOLLOVV'S: <br />Section 1. The Common Council of the City of Eugene finds that due and <br />regular notice of said hearing was published and posted as required by law and that <br />no valid objection has been made at said hearing or filed. That the consent of the <br />oumers of the abutting property has been duly and regularly filed in said proceeding <br />and that the public interest will not be prejudiced by the vacation of said portion <br />I~ of alley. <br />`~ Section 2. That said hearing was held on the ]1.~th day of July, lg1.r.7, <br />at 7;30 o~cloek P.M., in the Council Chambers of the City Hall of Eugene, Lane County <br />Oregon, and that all matters necessary to be done in the premises have been duly and <br />regularly completed. <br />Section 3. That the following described area, to-wit; <br />1 That certain platted alley between 7th and $th Avenues <br />Vilest, extending from Filmore Street to Almaden Street in ' <br />the City of Eugene, Oregon, except the South 11~.feet thereof, <br />be and the same is hereby vacated and the area so vacated, being a portion of the <br />public alley, shall revert to the abutting property ou~mers pursuant to the statutes: <br />of the State of Oregon, reserving, however, unto the City of Eugene, and any of its <br />I <br />agencies, the perpetual right to maintain any public utility or structures new or <br />hereafter located upon and within the area vacated, and to lay de~vn and construct at <br />any time the City of Eugene or any of its agencies shall deem necessary or convenient, <br />any public utility grithin said area, and reserving the right to enter upon said <br />vacated area for the purposes aforesaid. <br />I~ <br />~I <br />
