X99 <br />ORDINANCE N0. 903t~ <br />' An Ordinance vacating the follotrring described area, to-tirit; <br />~~ That part of Emerald Street between the South line of Thirteenth <br />~ Avenue East and the North line of Fourteenth Avenue East, in <br />the City of Eugene, Oregon, <br />Ti~THEREAS, heretofore and on the 9th day of June, 19.7, the Common Council <br />of the City of Eugene, passed an Ordinance setting a hearing for the ll~th day of <br />Jul 1 at the Council Chambers at which time and lace rotests and remonstrances <br />~ y~ 947s s T~ P <br />~ could be heard as to the proposed vacation of the following premises, to-wit: <br />That part of Emerald Street between the South line of Thirteenth <br />Avenue East and the Tdorth line of Fourteenth Avenue East, in <br />the City of Eugene, Oregon ; <br />and <br />WHEREAS, due notice was duly and regularly given of said hearing and a <br />~,'i hearing was held pursuant to said Ordinance in the Council Chambers of the City Hall <br />~ in Eugene, on P2onday, the ]lath day of July, 191.7, at 7;30 otclock P.PlL, and at said <br />I <br />time the Council heard all objections; and <br />WHEREAS, all persons owning property abutting upon said street proposed <br />to be vacated have consented to said vacation and have applied for the same. <br />~ THE CITY OF EU(~AlE DOES ORDAITJ AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene finds that due and <br />~` <br />regular notice of said hearing was published and posted as required by law and that <br />no valid objection has been made at said hearing or filed. That the consent of the <br />owners of the abutting property has been duly and regularly filed in said proceeding <br />,, and that the public interest will not be prejudiced by the vacation of said portion <br />of street. <br />Section 2. That the hearing was held on the ]lath day of July, 19l~7, at <br />7:30 otclock P.It+I., in the Council Chambe rs of the City Hall of Eugene, Lane County, <br />Oregon, and that all matters necessary to be done in the premises have been duly and <br />regularly completed. <br />i Section 3. That the following described area, to-~vit; <br />That part of Emerald Street between the South line of Thirteenth <br />Avenue East and the North line of Fourteenth Avenue East, in <br />the City of Eugene, Oregon, <br />be and the same is hereby vacated, and the area so vacated, being a portion of the <br />~ public street, shall revert to the abutting property ovaners pursuant to the statutes <br />of the State of Oregon, reserving, hovrever, unto the City of Eugene and any of its <br />agencies, the perpetual right to maintain any public utility or structures now or <br />hereafter located upon and within the area vacated, and to lay down and construct at <br />any time the City of Eugene or any of its agencies shall deem necessary or convenient, <br />any .publio utility within said area, and reserving the right to enter upon said <br />vacated area for the purposes aforesaid. <br />I <br />
