ORDINANCE NO. 20568 <br />AN ORDINANCE EXTENDING THE RENTAL HOUSING CODE SUNSET DATE <br />AND PROVIDING FOR AN EFFECTIVE DATE. <br />The City Council of the City of Eugene finds as follows: <br />A. <br />Sections 8.400 through 8.440, and 8.995 of the Eugene Code, 1971, (“theRental <br />Housing Code”) were adopted by Ordinance No. 20329 on November 22, 2004. Ordinance No. <br />20329 also provided that the Ordinance and the Rental Housing Code be repealed effective <br />December 31, 2008. <br />B. <br />On May 27, 2008, Ordinance No. 20408 was enacted extendingthe sunset date <br />to December 31, 2011. On November 28, 2011, Ordinance No. 20480 was enacted amending <br />provisions of the Rental Housing Code and extending the sunset date to September 30, 2012. <br />On June 11, 2012, Ordinance No. 20494 was enacted amending the Rental Housing Code and <br />extending the sunset date to September 30, 2016. <br />C. <br />The Council has determined that the September 30, 2016sunset date and repeal <br />date of the Rental Housing Code should be extended toMarch 1, 2017. <br />D. <br />Pursuant to the Eugene Charter of 2002, an ordinance takes effect 30 days after <br />its adoption by the City Council and approval by the mayor. However, with the affirmative vote <br />of two-thirds of the members of the City Council, and upon adoption by the Council and <br />approval by the Mayor, an ordinance may become effective immediately. (Eugene Charter of <br />2002, Section 32(2).) <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. <br />Unless otherwise extended by action of the City Council, the sunset date <br />andrepeal of Ordinance Nos. 20329, 20408,20480,20494, andthis Ordinance,is March 1, <br />2017. <br />Section 2. <br />Copies of this Ordinance shall be appended to Ordinance Nos. 20329, <br />20408,20480and 20494. <br />Section 3 <br />.Notwithstanding Section 1of this Ordinance, any enforcement actions <br />commenced to enforce the Rental Housing Code provisions prior to March 1, 2017, may <br />continue to be pursued, and the provisions related to such enforcement actions shall remain in <br />effect with respect to those actions. In addition, any fees owed to the City under the provisions <br />of the Rental Housing Code remain due and owing, and all provisions related to those fees and <br />their collection shall remain in effect with respect to those fees. <br />Section 4 <br />.Because the Rental Housing Code provisions are currently scheduled to <br />sunset on September 30, 2016, an effective date of less than 30 days after adoption is <br />necessary so that the Rental Housing Code provisions remain in effect without interruption. <br />Ordinance -Page 1of 2 <br />
