<br />An Ordinance a.r:ending Section 2 of Ordinance No; 6239 entitled "An Ordinance granting
<br />to.Southe~n Pacific Company, its successors and assigns, the exclusive franchise,
<br />right and privilege to operate passenger busses upon and a.long•thQ streets, avenues,
<br />thoroughfares and public high~;:ra,ys in the City of Euger..e, State of Oregon, for the pur-
<br />pose of conducting; and urban passenger bus business, and providing the terms, pro-
<br />visions and. restrictions subject to arhich the said- operations of s - id grantee ~znder
<br />said franchise shall be exercised.~'~; provi~izig ten (10¢) as the maximum rate of fare
<br />for each tri in one general direction in the City of Eugene, and t~~renty-five (25¢)
<br />~-for-three (3~ strip tickets, a.nd providing for an emergency.
<br />WHEREAS, the City of Eugene p~.ssed Ordinance No. 6239 granting unto the Southern
<br />Pacific Company, its successors a.nd assigns, a franchise to operate passenger busses moon
<br />the streets of the City of Eugene under certain restrictions a.nd for certain fares, ~.nd
<br />WHEREAS, The Southern Pacific Company has heretofore assigned a.11 their right, title
<br />and interest in and to said franchise to Oregon Motor Stages, and. Or~~on corporation, and
<br />YJHEREAS, Oregon Motor St~.ges have made application to amend said franchise and. have
<br />made, a sho~,ring to the, Common Council of the City of Eugene that operating expenses of the
<br />Oregon Motor Stages have greatly incre~.sed and. in order to meet said operating expenses
<br />additional revenue is needed. -
<br />Now, Therefore •
<br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOYdS:
<br />Section 1. That Section 2 of Ordinance No. 6239 entitled "An Ordinance granting to
<br />Southern Pacific Company, its successors and assigns, the exclusive franchise, right and
<br />privilege to oiler-.te passenger b,~sses upon and. along the streets, av~rues, thoroughfares
<br />and. n~ablic high~•rays in the City of Eugene, State of Oregon, for the purpose of conducting
<br />an-urban passenger bus business, and providing the terms, provisions, a.nd restrictions
<br />subject to t:~hich the said operations of said grantee under said franchise sha7.1 be exer-
<br />cised." , passed by the Common Council on the l~~th day of September, 1927, and apy roved by
<br />the Mayor on the l~?th day of September, 1927, be, and the s~.me is hereby, amended to read
<br />as follows:
<br />"Section 2. The maximumrat~ of fare ~r?hich may be charged by the grantee herein for
<br />each trip in one general direction ~Jrithin the present limits of the City of Eugene, shall
<br />not be Mcre than ten (10¢), provided, hot~~ever, that the grantee shall be required to furnish
<br />and. to sell three (3) strip tickets at the price of twenty-five cents (25~}; provided fur-
<br />ther that in the event the State of Oregon shall subsequently enact legislation providing
<br />for state regala.tien ail nlicable to the operations of the ~ranteP hereunder, the matters of
<br />rates of fare to be charged by the grantee shall automatically become subject to any a,nd
<br />all such regul~~tion."
<br />Section 2. Whereas Oregon Motor Stages have declared that they are no~~r~operating busses
<br />~~ S~
<br />~rithin the City of Eugene at a, financial loss and h=ve rectuested the change in fares on or
<br />bef ore Jamaary 1, 19L~, and emergency is hereby declared to exist, and. it is declared to be
<br />necessary for the immediate preservation of the peace, health and s-.fety of tre citizens
<br />of the City of Eugene that this Ordinance take effect inLmediately upon its pass-ge and
<br />approval anal it is so ordered.
