<br />An Ordinance initiating the vacation of the following described premises, to-wit:
<br />A part of Clark Avenue betvreen Monroe and Adams Street more particularly .
<br />described as follows: Commencing at a point on the South line of Clark
<br />Avenue 20 feet Southwesterly from the Northeast corner of Lot 5, Block 6,
<br />Riverurood Addition, running thence South 51~° `V'est 95 feet, thence on a
<br />crave to the left having a radius of 30 feet to a point 71 feet North, 28°
<br />Ytest of the Southwest corner of Lot l~, Block 6, Riverwood Addition, thence
<br />South 28° East 22 feet, thence on a curve to the right having a radius
<br />of 40 feet to a point I~0 feet South 1~7° 30' West of the northwest corner
<br />of Lot 5, Block 6, Riverwood Addition, thence North 1t7° 30' East 90 feet
<br />to the place of beginning,

<br />and calling a hearing and directing thatnotice be given.

<br />Section 1. I'he Common Council of the pity of Eugene hereby initiates vacation pro-
<br />ceedings on its oxn authority without petition or consent of the property owners, ex-
<br />cepting as provided by statutes, of the following described property, to-tivit:
<br />A part of Clark l~venue between Monroe arxi Adams Street more particularly
<br />described as follows: Commencing at a point on the South line of Clark
<br />Avenue 20 feet Southwesterly from the Northeast corner of Lot 5, Block 6,
<br />River~vood Addition, running thence South 5!~° T+IPst 95 feet, thence on a .
<br />curve to the left having a radius of 30 feet to a point 71 feet North, 28°
<br />West of the Southwest corner of Lot 1~, Block 6,.Riverwood Addition, thence
<br />South 28° East 22 feet, thence ~n a curve to the right having a radius of
<br />!t0 feet to a point 40 feet South 1~7° 30' West of the Northwest corner of
<br />lot 5, Block 6, Rivex~ood Addition, thence North 1~7° 30' East 90 feet to
<br />the place of beginning.
<br />Section 2. A hearing shall be held upon the proposal to vacate said premises~as

<br />herein provided, and said hearing shall be held on the.l2th day of July, 19l~8, at 7:30
<br />o'clock P.M. of said day, at wh~.ch time all persons will be heard upon objections or
<br />suggestions with reference to the vacation of said portion of said street and at said
<br />time the Council will provide for the vacation of said premises or deny such vacation,

<br />and in case the vacation is made will make provisions for any damages sustained by local ~
<br />assessment .
<br />Section 3. The City Recorder be, and he is hereby, required to immediately publish
<br />for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, notice
<br />of the proposed vacation. Such notice shall give the description of the area to be va-
<br />cated as herein set out, and state the date when this ordinance was passed; the name of
<br />any petitioners petitioning for said vacation; the date when the said petition, together
<br />with any objections or remonstrances which may be made in writing and filed vrith the
<br />City Recorder prior to the date of said hearing, will be heard and considered. ~
<br />Section !t. .The City Recorder shall forthwith and within five days after the first
<br />publication of said notice, post or cause to be posted at or near each end of said pro-
<br />posed vacation, a copy of the foregoing notice, which shall be headed "Notice of Street
<br />Vacation' and which notice shall be posted in at least two conspicuous places in such
<br />proposed vacation or such area.
<br />The posting and the first day of publication of such notice shall not be less than
<br />twenty4-eight days before the time set for hearing.
