r .. <br />~~~ <br />o~INANCE No . 9174 <br />An Ordinance to construct a sanitary sewer on the East side of V~ashington Street from <br />Twenty-fourth Avenue to Tvdenty-fifth Avenue in the City of Eugene, and declaring an emergency; <br />THE CITY OF EUGENE DOES..ORDAIN AS Fl~LLOWS: <br />Section 1. The Common Council of the City of Eugene does hereby declare its intention it <br />1 <br />to build and construct a sanitary sewer on the East side of tiYashington Street from Twenty- ~~ <br />it <br />fourth Avenue to Twent~~-fifth Avenue in the City of Eugene, Oregon. '~ <br />~; <br />~, <br />Section 2. That the said sewers shall be constructed of first class cement, vitrified i~ <br />y <br />pipe, or other suitable material according to the plans and specifications of the pity <br />Engineer. <br />Section 3. The City Engineer is hereby directed to survey out the location of said <br />sewers, and prepare plans and specifications and a profile thereof, and to file the same <br />with the City Recorder. <br />Section 1.~. The construction of said sevrers shall include all necessary manholes, wyes, <br />and all things necessary and convenient for the complete building thereof. <br />Section 5. The cost of the construction of said sewers shall be borne by and shall be <br />assessed to the lots, parts of lots and acreage properly liable therefor, and benefitted by <br />the construction thereof in proportion to the benefits accruing to each lot, part of lot or <br />acreage properly liable as shall be ascertained and determined bythe Common Council of the <br />City of Eugene, except street intersections, which will be paid for by the City, and there <br />shall be included as a part of the costs thereof, the Engineer's charges for his services <br />thereon, not to exceed 5q' of the contract price therefor. <br />Section 6. Upon the completion, of the sevrer, the Common Council shall ascertain the <br />cost thereof and assess that portion thereof against the lots, parts of lots or acreage <br />properly liable therefor or benefitted thereby in accordance with the provisions of the <br />Charter of the City of Eugene, and when said costs are so assessed the same shall be entered <br />in the City Lien Docket, bnd be further enforced as provided b y tdze City Charter. <br />Section 7. trdhereas, the improvement contemplated and provided for by this ordinance <br />is a necessary improvement and the district of the city in which said sevrer is to be <br />constructed is in such a condition that the construction of said sevrer is essential to the <br />health and safety of the residents of said district, it is therefore declared that an emer- <br />gency exists and it is necessary for the immediate preservation of the public peace, health <br />and safety, that this ordinance take effect immediately upon its passage by the Council and <br />approval by the Mayor. <br />Fassed by the Common Council <br />this 28th day of J}.uie, 19l~8. <br />/s/ Henry F.
