~~30 <br />~--. 3 <br />ORDINANCE tJO. 9185 <br />An Ordinance to construct a sanitary sewer on the North side of First Avenue WPSt from <br />the Polk Street sewer to the ;~r~st City Limits in the City of Eugene, and declaring an emer- <br />gency. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOl~V5: <br />Section 1. The Common Council of the City of Eugene does hereby declare its intention <br />to build and construct a sanitary sewer on the Northside of First ~ivenue Test from the Polk <br />Street setiver to the West City Limits in the City of Eugene, Uregon. <br />Section 2. That the said sewer shall be constructed of first claas cement, vitrified <br />pipe, or other suitable material according to the plans and specifications of the City Engineer. <br />Section 3. The City Engineer is hereby directed to survey out the location of said sewers, <br />and prepare plans and specifications and a profile thereof, and to file the same with the <br />City Recorder. <br />Section 1~. The construction of said sewers shall include all necessary manholes, wyes, <br />and all things necessary and convenient for the complete building thereof. <br />Section 5. The cost of the construction of said sewers shall be borne by and shall be <br />assessed to the lots, parts of lots and acreage properly liable therefor, and benefitted by <br />the construction thereof in proportion to the benefits accruing to each lot, part of lot or <br />acreage properly liable as shall be ascertained and determined by the Common Council of the <br />City of Eugene, except street intersections, which will be paid for by the City, and there <br />shall be included as a part of the costs thereof, the Engineers s charges for this services <br />thereon, not to exceed 5~ of the contract price therefor. <br />Section 6. Upon the completion of the sewer, the Common Council shall ascertain the <br />cost thereof and assess that portion thereof against the lots, parts of lots or acreage pro- <br />perly liable therefor or benefitted thereby in accordance with the provisions of the Charter <br />of the City of Eugene, and when said costs are so assessed the same shall be entered in the <br />City Lien Docket, and be further enforced as provided by the City Charter. <br />Section 7. Whereas, the improvement contemplated and provided for by this ordinance is <br />a necessary improvement and the district of the City in which said sewer is. to be constructed <br />'is in such a condition that the construction of said sewer is essential to the health and <br />safety of the residents of said district, it is therefore declared that an emergency exists <br />and it is necessary for the immediate preservation of the public peace, health and safety, <br />that this Ordinance take effect immediately upon its passage by the Council and approval by <br />the Mayor. <br />Passed by the Common Council <br />this 28th day of June, 1y48. <br />/s/ Henry F.
