~.3~ <br />ORDIPdAP1CE N0 . 9187 <br />An Ordinance vacating the following described property, to-wit: <br />The alley running North and South betvreen Charnelton , <br />and Lincoln $treet~from Tenth to Eleventh Avenue. <br />VI(HEREAS, heretofore and on the 10th day of May, 19t~8, the Common Council of the City <br />of Eugene passed and Ordinance setting a hearing for June 28, 19It8, in the Council Chambers at . <br />vrhich time and place protests and remonstrances could be heard as to the vacation of the <br />following premises, to-ti~rit: <br />The Alley running North and South between Charnelton <br />and Lincoln Street from Tenth to Eleventh Avenue . <br />1 <br />~7HEREAS, a hearing was held pursuant to said Ordinance in the Council Chambers in the <br />City Hall in the City of Eugene on June 28, 19118, at 7:30 o~clock F.M. and at said time the <br />Council heard all objections; and <br />ti°JHEREAS, all persons owning property abutting upon said area have consented to said <br />vacation; <br />THE CI`PY OF EUGENE DJES ORDAIN AS FOLLOV'7S: i <br />Section 1. The Common Council of the City of Eugene finds that due and legal notice <br />of the said hearing was published and posted as required by law; that no valid objection <br />to said vacation has been made at said hearing, or filed; that the consent of the owner <br />of the abutting property, properly acknowledged, has been filed i.n said proceedings; and <br />that the public interest will not be prejudiced by the vacation of said area. <br />.Section 2. That said hearing was held on June 28, 19l~8, at 7:30 o'clock P.M. in the <br />Council Chambers of the City Hall in Eugene, &~ane County, Oregon, and no objections or <br />remonstrances were made or filed. <br />A <br />Section 3. That the following described area, to-wit: <br />The alley running North and South between Charnelton +~+ <br />and Lincoln Street from Tenth to Eleventh Avenue I <br />be, and the same is hereby, vacated, and the area so vacated, being an alley, shall revert <br />to the abutting property pursuant to the staututes of the State of Oregon, reserving the right <br />for the City to maintain, repair and operate its public utilities. <br />Section 14. The recorder be, and he is hereby, directed to file a certif~.ed copy of this <br />Ordinance with the County Clerk of Lane County, together with a map or plat of said property, <br />and that a certified copy of the Ordinance shall be filed with the County Assessor, and <br />another certified copy of the Ordinance shall be filed with the County Surveyor. <br />Passed by the Cammon Council <br />this 28th day of June, lyl~8. <br />1 <br />/s/ Henry F.
