The Common Council of the Cit,;T of Eugene does hereby declare its intention <br />to build ~.~nd construct a sanitar^,r sevrer in the follov~ring described s+,reet: <br />E~:st Side of "~Ia.shington Street from Tzr:;ntythird l~verzue to Twrentyfcurth t~venue, <br />in the City of Eugene, Oregon. <br />Section 2. That th:~ said sewer shall ~ constructed of first class cement, vitrified <br />pipe, or other suitable material according to the clans -ind specifics ti ens of the City <br />ling ineer. <br />Section 3. The City Engineer is hereby direc+~d to surve;,= cut the locat~_or. of said <br />sewer, and prepare plans and specifications ar~d a profile thereof and to file the same ~rrith <br />the City Recorder. <br />Section ~;. The construction of s_~id sevrer shall include all necessary- manholes, v~ryes, <br />and all things necessary and convenient for the complete building thereof. <br />:Section ~. Tha.t the cost of the construction of said sevrer shall be borne by arzd shall <br />be assessed. to the lots, parts of lots and acreage properly liable therefor, and benefitted <br />by the construction thereof in proportion to the benefits accruing to each lot,, part of lot <br />or acreage properly liable as shall be ascertained and detPx:r:irzed by the Common Council of <br />the City of Eur;ene, eycept street intersections, vrhich Trill be p~~.i_d for by thc; City, and <br />there shall be included as apart of the costs thereof, the Engineer's charges for his <br />services thereon not to exceed ~ of the coni;ract price therefor. <br />Section 6. Upon the completion of the sevrer, tYze Conunon Council shall ascertain the <br />cost thereof and assess +,hat portion thereof against the lots, parts of ]_ots or acreage proper <br />.~ <br />liable therefor or benefitted thereby in accordance vrith the provisions of the Charter of <br />the City of Eugene, and vrher. said costs are so assessed the same sha]_1 be entered in the <br />City Lien Docket, and be further enforced as provided by the City Charter. <br />Sect ion 7 . 'I~7zereas, the improvement contemplated and provided for by this ordinance <br />is a necessary improvement end the district of the cit,~r in which said sevrer is to be con- <br />structed is in sucha condition that the construction of said sewer is essential to the health <br />and safety of the residents of said district, it is, therefore, declared that an emergency <br />exists and it; is necessary for the inmediate preservation of the public peace, health and <br />safety, that this ordinance take effect izr!m<:diately upon its passage by the Council and <br />approval by the I~.2ayor. <br />Passed by the Common Council t~iis <br />27th day of September,.lq~8. <br />j sl Henry F.
