r~~~ <br />~ ORDINANCE N0. 9231} <br />An Ordinance initiating the vacation of the follovring described premises, to-Vrit: <br />Fourteenth Street East betvreen the Easterly line of University Street and the <br />Westerly line of Onyx :Street, in the City of Eugene, Lane County, State of Oregon, <br />and the alley running North and South in the block bounded by thirteenth Avenue <br />and fourteenth Avenue, and University and Onyx Street, <br />and calling a hearing and directing that notice be gi.vE:n. <br />THE CITY OF EUGL~tE DOES ORDAIN AS FOLLOWS: <br />i Section 1. The Common Council of the City of Eugene hereby initiates vacation proceed- ~ <br />I~ I <br />ings on its own authority vrithout Y~tition or consent of the property owners excepting as <br />1 provided by statutes of the follovring described property, to-wit: <br />Fourteenth Street East between the E~rsterly line of University Street and the I <br />~ Westerly line of Onyx. Street, in the Citzr of Eugene, Lane County, State of Oregon, ~ <br />~ and the alley running North and South in the block bounded by Thirteenth .venue I <br />i and Fourteenth Avenue, and University and Onyx Street. <br />~ t <br />Section 2. A hearing shall Yee held upon the proposal to vaca+,,e said premises as. herein f <br />provided and said hearing shall be held on the 22nd day of November, 19l~8, at 7:'30 o'clock <br />M <br />P.M. of said day, at which time all persons will be heard upon objections or suggestions with I~ <br />reference to the vacation of said portion of said street and at said time the Council will providE <br />i <br />for the vacation of said premises or deny such vacation, and in case the vacation is made will f <br />make provisions for any damages sustained by local assessment . <br />Section 3. The City Recorder be, and he is hereby, required to immediately publish for <br />four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, notice of <br />the proposed vacation. Such notice shall give the description of the area to be vacated as ~I <br />':~ <br />herein set out, and state the date when this ordinance was passed; the name of any petitioners ,. <br />;, <br />petitioning for said vacation; the date vrhen the said petition, together with any objections I~ <br />., <br />i~ <br />or remonstrances which may be made in vrriting and filed with the pity Recorder prior to the I! <br />i <br />date of said hearing, will be heard and considered. ~~ <br />~~ <br />Section 1~. The City Recorder shall for..thwith and within five days after the first pub- <br />r <br />lication of said notice, post or cause to he pasted at or near each end of said proposed va- ~I <br />cation, a copy of the foregoing notice, which shall be headed "Notice of Street Vacation" and ~,l <br />which notice shall be posted in at least two conspicuous placE:s in such proposed vacation or <br />such area. <br />The posting and the first da;~ of publication of such notice shall not be less than twenty- <br />eight days before the time set for hearing. <br />Passed by the Common Council this <br />11th day of October, 191;8 . <br />;~s/ Henry F.
