<br />ORDZPJANCE N0. 9235 <br />An Ordinance initiating the vacation of the follovring described premises, to-wit: <br />Oak Grove Drive from the southerly line of Spring boulevard to the southerly line <br />of Lot 13 in block 1 of first addition to Fairmount Heights, Eugene, Lane County, <br />State of Oregon. <br />~d calling a hearing and directing that notice be given. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The Common Council of the City of Eugene hereby initiates vacation proceed- <br />1 <br />ings on its own authority without petition or consent of the property owners, excepting as <br />provided by statutes, of the follovring described property, to-wit: <br />Oak Grove Drive from the southerly line of Spring Boulevard to the southerly line <br />of Lot 13 in Block 1 of first addition to Fairmount heights, Eugene, Lane County, <br />State of Oregon. <br />Section 2. A heari.n~; shall be held upon the proposal to vacate said premises as herein <br />provided, and said hearing shall be held on the 22nd day of November, 19l~8, e.t 7:30 o~clock <br />P.Fd. of said day, at which time all persons will be heard upon objections or suggestions with <br />reference to the vacation of said portion of s~:id street and at said time the Council will <br />provide for the vacation of said premises or deny such vacation, ~,nd in case the vacation is <br />made will make provisions for any damages sustained by local assessment. <br />Section 3. The City Recorder be, and he is hereby, required to immediately publish <br />for four consecutive vreeks in a newspaper published in Eugene, Lane County, Oregon, notice <br />of the proposed vacation. Such notice shall give the description of the area to be vacated <br />as herein set out,. and state the date vrhen this ordinance ryas passed; the name of any peti- <br />tioners petitioning for said vacation; the date when the said petition, together with any <br />objections or remonstrances which may be made in writing and filed with the City Recorder <br />prior to the date of said hearing, vrill be heard and considered. <br />Section ~.. The City Recorder shall forthwith anal within five days after the first publi- <br />cation of said notice, post or cause to be pos ted at or near each end of said proposed vaca- <br />tion, a copy of the foregoing notice, which sha7_l be headed ~-Dlotice of Street Vacation" and <br />w~~ich notice shall be posted in at least two conspicuous places in such proposed vacation of <br />such area. <br />The Posting and the first day of publication of such notice shall not bc~ less than twenty- <br />1 <br />eight days before the time set for karing. <br />Passed by the Common Council this <br />11th day of October, 1918. <br />/s/ henry F.
