<br />Section 1. T^hat erection XVII of Ordinance No. 9188, which vras passed by the Common Council
<br />of the Cit;r of Eugene on June 28, 1948, and approved b~- the 1Wayor of the City of Eugene on
<br />the 29th day of June, 1948, be, and that the same is hereby amended to read as follows,

<br />SECTIOPJ XVII P~10NCONFORr.4ING USES
<br />A-: Any lawful use existing in any building, strl.icture, or premise, at the time of tY~
<br />passage of this Ordinance, may be continued trierein although not conforming to the district
<br />in vrhich it is maintained; provided that:
<br />1. The only noriconformirig use allowed will be the one which existed upon the date this
<br />Ordinance was passed, or one similar thereto.
<br />2. In the case a business or industr;,~ is being maintained in a residence district,. the
<br />building, structure, or premise in or upon vrriich it is maintained shall not be enlarged in
<br />height nor bulk.
<br />3. If the nonconforming use is discontinued, for any reason, for more than one (1)
<br />year, it shall not be re-established.

<br />B. Any nonconforming building or structure not started or completed on the effective
<br />date of this Ordinance, and for which a building permit has been issued, may be started with-
<br />in a period of six (6) months and completed within a period of eighteen (18) months after
<br />said effective date.
<br />Section 2. WHEREAS, various citizens of the Cite of Eugene are being adversely affected by
<br />the enforcement of Ordinance No. 9188, as the same is nov+r dravrn, an emergency is therefore
<br />declared to exist, and it is declared to be necessary for the immediate preservation of the
<br />peace, health and safety of the City of Eugene that this ``rdinance take effect upon its pas-
<br />sage by_the Common Council and its approval by the Mayor, and it is so ordered.
