~~~ <br />ORDINAt~1CE P10. 92 _ S~.e P~Ge J~S~- <br />An Ordinance prov-i_din~j for, authorizing and directing the inclusion in all improvement <br />1 <br />assessments and inprovement charges and liens hereafter levied by the Common Council of the <br />City of t;uā¬;F:ne, as apart of the cost thereof, a sum of money not to exceed five per cent of <br />the amount paid the contractor for said improvement, to co~.~er the cost of engineering, and a <br />sum of money not to exceed five per cent of the amount paid the contractor for said improve- <br />ment to cover th~~ cost of interest on warrants, advertising, postage and supplies for mailing <br />notices of assessments and directing- the City Iecorder-treasurer to enter said charge in the <br />lies docket of the pity of Eugene and to collect the same from the property owners benefitted <br />b,y said improvement in the same proportion and. manner as other improvement costs are collect- <br />ed, and re~~aling ordinance No. 9269 and all ordinances and ,~-~ its of ordinances in c~flict <br />herevri_th, and declaring an emergency. <br />~iE IT ORDAIr1E~ BY THE GI'Iy OF EUGENE: <br />Section 1. That the Common Council of t7re Cit;r of Eugene shall hereafter include in all <br />1 <br />assessment ordinances as apart of. the cost of any improvements incurred in the construction, <br />improvement or r~;pair of streets, alleys, sidevralks and sewers, a sum of money not to exceed <br />five per cent of the amount paid to the contractor for the construction of said improvement <br />as a charge to cover the cost of engineering, and a stmt of money not to exceed five per cent <br />of the amount mid to the contractor for said improvement to cover the cost of interest on <br />warrants, advertising, postage and supplies for mailing notices of assessments. That said <br />charges shall be included as apart of the cost of imhrovement and shall be declared by the <br />Common Council to be an ob]_igation of the property owner benefitted by said improvement in <br />the proportion provided by the charter and ordinances of the City of Eugene, and further dir- <br />ecting that said charges shall be included as a lien upon the real property benefitted by <br />said improvement, and payable by said property otimer in the same manner as the remainder of <br />the cost of said. improvement . <br />erection 2. The Cit;,T Recorder-Treasurer of the City of Eugene is hereby authorized and <br />directed to include said charges set forth i_n Section 1 in all improvement liens and; after <br />the cost of said improver,ient or repairs has been ascertained and the proportionate share <br />thereof allocated to each lot, part of lot, and acreage liable therefor, to enter the same <br />in the docket of City dens for the Ci ~,y of ,?.ug;ene, together with a statement containing a <br />description of each lot, part of lot or acreage prop°rl~r liable for such improvement, and <br />the .name of the cvaner or reputed otivner thereof, or that the name of the ov~mer is unknown. <br />Section 3. That the charges herein provided for shall hereafter be deemed to be a <br />part of the cost of any constr2iction, improvement or repair in the City of Eugene, and shall <br />be subject to all charter, ordinance and statutory provi_si ons pertaining to the assessment and <br />collection of the cost of said improvements. <br />1 <br />Section 1.t~ That Ordinance No. 9269, passed by the Common Council on the 2hth day of <br />January, 1949, and approved by the ~+Ia~*or on the 25th day of January, 19u9, and all other ord- <br /> <br />
