,~/~ <br />ORDINANCE N0. 9285 <br />An Ordinance to construct a sanitary sewer in the alley between Harris and Potter Street <br />from Twenty-eighth Avenue to Tvrent~n::.nth Avenue, in the City of Eugene, and declaring an <br />emergency. <br />THE CITY OF EUG%NE 1~OES 7I~AIN AS FnLUJYlS: <br />Section 1 The Common Council of the City of Eugene does hereby declare its intention .~to <br />build and construct a sanitary sewer in the alley between Harris .and ?otter Street from Twenty- <br />j eighth Avenue to Twentyninth Avenue, in tkie City of Eugene, Oregon <br />Section 2. That said sevrer shall b° constructed of i'irst class cement, vitrified pipe, <br />i or other suitable material according to the plans and specifications of the City Engineer. <br />j Sectirn 3, The City Engineer is hereby directed to survey out the location of said <br />sewer, and prepare plans ans specifications and a profile thereof, and t o .File the same with <br />the City Recorder . <br />5ecti.on 4, The cons tructirn of said sewers shall include all necessary manholes, wyes, <br />and all things necessary and convenient for the complete building thereof. <br />Section 5. The cost of the constructi~ of said s ewer shall be borne by and shall be <br />assessed to the lots, parts of lots and acreage properly liable therefor, and benefitted by <br />the c ors traction thereof in proportion to the benefits accruing to each lot, part of lot or <br />acreage properly liable as shall be ascertained and d etermined by the Common Council of the <br />City of Eugene, except street intereecticszs, which will be paid for by the City, and there <br />shall be included as a' part of the costs thereof, the Engineers charges for his services there- <br />on, not to exceed 5~ of the contract price thereof. <br />Section 6, Upon the completion of the sewer, the Common Council shall ascertain tine cost <br />thereof and assess that protion tYiereof against the lots, parts of lots or acreage properly <br />liable therefor or benefitted thex~by in accordance with the pao~ti§irns of the Charter of the <br />City of Eugene, and when said costs are so aesessed the s ame shall be entered in the City Lien <br />Docket, and be further enforced as provided by the City Charter. <br />Section 7, V~.,REA5, the improvement, contemplated and provided for by this ordinance is <br />a necessary improvement and the district of the City in whic~a said sewer is to be constructed <br />is in such a condition that tk~e construction of said selrrer is essential to the health and <br />safety of the rediden is of said district, it is therefore declared treat an emergency exists <br />and it is necessary for t he inmediate prese~rvaticr~ of the public peace, health and safety, <br />that this ordinance take effect immediately ug~o~t its passage by the Council and approval by <br />the Mayor . <br />Passed. by the Common Council this28th .: <br />day of March, 1919 . <br />fs/ Henry F.
