~8~1 <br />ORDIPI,APJCE N0. 9308 <br />Are Ordinance to construct a sanitary sewer on Emerald Street from Twentysixth to Tw~:hty- <br />eighth Avenue in the City of Eugene, Oregon, and declaring an en ergency. <br />THE CITY OF EUGEnTE IYJES ORDATPI AS FOLLOVdS: <br />Section 1. The Common Council of the City of Eugene does hereby declare its intention <br />to build and construct a sanitar~T s sorer on Emerald Street from Tarentysixth to Twentyei.ghth <br />Avenue in the City of Eugene, Oregon. <br />Section 2. That said sewer shal]_ be constructed of first-class cement, vitrified pipe, <br />or other suitable material according to the plans an d specifications of the City Engineer. <br />Section 3. The City Engineer is hereby directed to surrey out the location of said <br />1 <br />sewer, and prepare plans and specifications an~~ a profile thereof, and to file the same with <br />the City Recorder. <br />Section ~. The construction of said sewers s hal]_ include all necessary man holes, wyes, <br />and all things necessary and convenient for the complete building thereof. <br />Section ~. The coat of the cons tru8tio21 of said sewer shall be borne b~r and shall be <br />assessed to the lots, parts of lots and acreage properly liable therefor, and benefi.tted by <br />the construction thereof in proportion to the benefits accruing to e ach lot, part of lot or <br />acreage properly liable as shall b e ascertained and determingd by the Cor;mon Co~ICil of the <br />City of Eugene, except street intersections, which will be paid for by the City, and there <br />shall included as apart of the costs thereof,,- the Engineer's charges for his services thereon, <br />not to exceed 5~ of the contract price therefor, and charges for interest on improvement wart-~ <br />ants, adveutising for bids, postage and supplies for mailing notices of assessments not to <br />exceed 5~ of the contract price therfor. <br />Section 6. Upon the, completion of the sewer, the Common Council shall ascertain the <br />1 <br />cost thereof and assess that protion thereof against the lots, parts of lots or acreage pro- <br />perly liable therefor or benefitted thereby in acc ordance with the provisions of the Charter <br />of the City of Eugene, and when said costs are so assessed the same shall be entered in the <br />City Lien Docket, and be further enforced as provided by the City Charter. <br />Section 7. V'1HERE,AS, the improvement contemplated and provided for by this ordinance <br />is & necessary improvement and the district of the Cit~r inwhich said sewer is to be con- <br />structed is in such a condition that the construction of said sewer is essential to the <br />health and safety of the residents of said district, it is therefore declared that an emerg- <br />ency exists and it is necessar~r for the immediate preservation of the public peace, health and <br />safety, that this ordinance take effect irmlediately upon its passage by the Council and approval <br />by the Ma ~~r . <br />Passed by the Coramon Council <br />this 18th day of April, 1949 <br />Approved by the Mayor th_s <br />19th day of April, 1919. <br />/s/ Henry F.
