X85 <br />ORDIPdAb?CE 9311 <br />An Ordnance adopting the plans and specifications of the City F,ng=_neer for .the oonstruct- <br />1 <br />ion of a sanitar~,r sewer on Onyx Street from Tvventysixth A~;enue to T+rrentyeightn Avenue in the <br />pity of Eugene, Or:~gon, directing the City Recorder to advertise for bids for the construction <br />os said sewer in accordance v~rith such plans and specifications, and notifying propel ty owners <br />when and bhere the, b~_ds therefor will be, opened and considered. <br />WHEREAS, the Cor,mon Council of the said C~ ty of Eugene, on thel~ith day of April, 1949, <br />passed Ordinance No. 9310 for the construction of said sewer 3.n the street described and set <br />forth in the title of this Ordinance, and said Ordinance tiaras approved by the Mayor ~of the <br />City of Eugene, on the 19th day of April, 1849; and <br />WHEREl~i, Section 3 of said Ordinance directed the City Engineer to make plans and spec- l <br />ifiications for the construction of said sewer~~. as specified in said Ordinance, and to f ile <br />the same with the City R&corder, and <br />WHEftEAS,i_n accordance with such instructions the City Eng':_neer has prepared said plans <br />and specifications and filed the same with the City Recorder of said City of Eug c31e on t Y~ <br />day of April, 1949, and the Co. men Council of the City of Eugene having examined and <br />approved the same; <br />Tl-~ CITY OF ETJGEPIE DOES ORDATPI AS FOLLCN+(S: <br />Section 1. That the plans and specifications of the City L:ngineer for t he tens true tion <br />of a sanitary sewer on Onyx S~reet froin_ Twentysixth to T~rehtveighth Avenue in the City of <br />Eugene, and doing such vrork as may be necessary to completely construct the same, are in all <br />things approved and adopted and the said sewer shall bt crnstrueted ir. a ccordance therewi th. <br />Section 2. That the City Recorder tie, and he is hereby, instructed to give notice to <br /> <br />contractors and pro;erty owners as provided in Sections 52, K3, 54, ~K, 56, 56B and 57 of <br />the Charter of the City of Eugene, inviting bids for the crnstruction of saids ewers as pre- <br />scribed in 'and in c nformity to said plans and. s pecifieati ens. <br />Section 3. That the Common Council d eclared that the said construction and the whole <br />thereof shall. be let as one contract and the City Recorder is directed. t o stcite in the notice <br />to contractors and propert~r owners that said contract will be let in one contract, and to also <br />state therein the time and place when and ~h ere bids for the construction d' said s etiver will be <br />opened and considered b,y the Common Council, and that at such time and place property owners <br />may file remonstrances against letting said contract. <br />Section 4. That the part;.T whose bid is accepted for said construction sign a contract <br />1 <br />for said work within ten days from the time of the receipt by him of the notification of the <br />acceptance of :his bid, and the word thereon shall b e commenced within ten days after the <br />letting of said ccmmtract, ari~ shall be completed within sixty days thereafter, unless an <br />extension of the t ime therefor be granted by the Common Council.
