<br />An Ordinance vacating the following described area, to-wit: Short Street from Mission
<br />
<br />Street to Spring Street in the City of Eu@:!ne, Oregon.
<br />
<br />1NHEREAS, heretofore and on the 22nd day of August, 1949 the Common Council of the City
<br />
<br />of Eugene, passed an Ordinance setting a hearing for the 26th day of Se!'tember, 1949, at
<br />
<br />the Council Chambers, a t which time and nlace nrotests and remonstrances could he heard as
<br />
<br />to the proposed vacation of the following permises, to-wit: Short Street from Mission Streeet
<br />
<br />to Spring Street in the City of Eugene, Oregon and
<br />
<br />'WHEREAS, due notice was duly and regularly given of said hearing and a hearing was held
<br />
<br />putsuant to said Ordinance in the Council ChaJnbers of the City Hall in Eugene, on Monday,
<br />
<br />September 26, 1949, at 7:30 P. m., and at said time the Council heard all objections; and
<br />
<br />WHEREAS, all persons owning pro';)erty a utting upon said avenue or street proposed to
<br />
<br />be vacated have consented to said vacation and applied for the same,
<br />
<br />THE CITY OF EUGENE DOES ORDAP' AS FOLLmVS:
<br />
<br />Section 1. The Common Council of the City of Eugene finds that due and regular notice
<br />
<br />of said hearing was publsihed and posted as requIred by law and that no valid obj ection has
<br />
<br />been made at said hearing or filed. That the consent of the owners of the abutting pro-
<br />
<br />perty has been duly and regularly filed in said proceeding and that the nublic interest will
<br />1

<br />not be pr~judiced by the vacati:m of said portion of drive or street.
<br />Section 2. That said hearing waw held on the 26th day of September, 1949, at 7:30
<br />
<br />o'clock p. m. in the Council Chambers of the City Hall of Eugene, Lane County., Oregon, and
<br />
<br />that all matters necessary to be done in the premises have been duly ad regularly completed.
<br />
<br />Section 3. That the following described area, to-wit:
<br />
<br />Short Street from Mission Street to Spring Street in the Ci 4Y of Eugene, Oregon
<br />
<br />be, and the same is hereby vacated and the area so vacated, ,being a portion of the street
<br />
<br />or drive, shall revert to the abutting property owners pursuant to the statutes of the State
<br />
<br />of Oregon, reserving, however, unto the Ci~ of Eugene and any of its agencies, the perpe-
<br />
<br />tual ri~ht to maintain any pubdc utility or structures now or hereafter located upon and
<br />
<br />within the area vacated, and to lay do\Vll and construct, at any time the City of Eugene or
<br />
<br />any of its agencies shall deem necessary or convenient, any pbblic utility wi thin said area,
<br />
<br />and reserving the right to enter upon said vacated area for the nurnoses aforesaid.
<br />
<br />Section 4. The Recorder be, and he is hereby directed to file aoertified copy of this
<br />
<br />ofdinance with the Recorde r of Lane County, Oreg:J n, to gethe r with a map or plat of said
<br />
<br />property and tha t a certified copy of this ordinance shall be filed with the County Assessor,
<br />
<br />and another certified copy of t his ordinance sha:.l be filed wi th the County Surveyor.
