~~~9 <br />OFZD INANC E NO : 942 ~~ <br />An Ordinance tc construct a sanitary sewer on the South side of Twenty-ninth Avenue from <br />Ferr;r Street to the 'Nest City Limits (alley between La•~nrrence and Washington Street), in the <br />City of Eugene, Oregon, and declaring an emergency, <br />THE CIT`.~_ OF EU':ENE DCES DEDAIN AS FOLLOV'TS: <br />Section 1. The Co.~nm:: n Co?zncil of the City of Euene does hereby declare its intentirn <br />to build and construct a sanitary sewer on the South side of TvYenty-ninth .Avenue from <br />Ferry Street to the West City Limits (alley between Lawrence and ~b`ashington Street) in the <br />City of Eugene, Oregon. <br />Section 2. That said sewer shall be constructed cf first-class cement, :vitrified pipe, <br />1 <br />or other suitable material according to the plans and specifications of the City Engineer. <br />Section 3. The City Engineer is hereby directed to survey out the location of said <br />sewer, and prepare plans and sz~ecifications and a profile thereof, and to file the same with <br />the City Recorder. <br />Section 1~. The construction of said sewers shall incL,ude all necessary manholes, wyes, <br />and all things necessary and convenient for ti~.e complete building thereof. <br />Section 5. The cost ~a.f the construction orsaid sewer shall.be bcarne by and shall k~e <br />1 <br />1 <br />assessed to the lots, parts of lots, and acreage prouerly liable therefor, and benefitted <br />by the construction thereof in proportior. to the '-enefits accr~_iing to each lot, Hart of <br />lot or acreage properly liable as shall .be ascertained and determined by the Common Council <br />of the City of Eugene, Oregon, except street intersections, which will be paid for by the <br />City, and there shall be included as a part of the costs thereof, the Engineers charges <br />for his services thereon, not to exceed 5~ of the contract price therefor, and charges <br />for interest on improvement warrants.;. advertising for bids, postage and supplies for <br />mailing notides of assessments not to exceed 5% of the contract price therefor . <br />Section 5. Upon the completion of the sewer, the Common Council shall ascertain the <br />cost of and assess that portion thereof agains,~ the lots,, r,~ is of lots or acreage properly <br />liable therefor or benefitted thereby in accordance with the nrovi.sions of. the Charter of <br />the City of Eugene, and ~nhen said costs are so assessed. the same shall be enter-ed in the <br />City Lien Docket, and: be further enforeced as provided by the City Charter. <br />Section 7. WHEREAS, the improvement contemplated and provided for by this ordinance <br />is a necessary improvement and the district of the City in wriich said sewer is t o be cons- <br />tructed is in such a condition that the construction of said sewer is essential to the <br />health and safety of the residents of said district, it is therefore declared that an <br />emergency exists and it is necessary for the immediate preservation of the public peace, <br />health and safety, that this ordinance take effect immediately upon its passage by the <br />Council and approval by the Mayor. <br />Passed by the Common Council th is <br />10th day of October, 19.49. <br />/s/ Henry F".
