The additional time allowed our <br />staff to meet with City staff (Peggy Keppler) and determine that our concerns are anticipated and <br />allowed for in the ordinance. <br /> <br />EWEB is often required to construct facilities such as reservoirs in isolated headwaters areas <br />with no developed stormwater facilities serving them. The requirements for flow control in <br />section 9.6792(3) appeared to require that EWEB disturb additional trees and natural resource <br />areas in order to meet the standards. Staff indicated that section 9.8030(24)(c)3 allows for <br />adjusting those requirements in this particular circumstance. The adjustment would be reviewed <br />and approved by the Planning Director and would not need a formal code variance or public <br />hearing. <br /> <br />EWEB has no objections to the adoption of the ordinance with the understanding that the <br />ordinance is flexible in balancing EWEB' s need to provide required public facilities to approved <br />development and the protection of both headwaters and the natural vegetation in their <br />watersheds. <br /> <br /> <br />Thomas E.
