<br />2. Achieving equity among the regional sewer users within the Urban Growth Boundary." <br />(Appendix A to the intergovernmental agreement specifies the Regional Sewerage Facilities as <br />including the Eugene/Springfield Regional Water Pollution Control Facility, located at 410 River <br />Avenue in Eugene.) <br /> <br />Staff is also recommending that the transfer of property occur at this time to facilitate the River Avenue <br />Transportation Improvement project and related potential assessments. <br /> <br />The River Avenue project requires acquisition of additional right-of-way for the transportation <br />improvements, and that cost is properly spread over the entire project, as is the cost of other right-of- <br />way acquisition for the project. The assessments would be levied to owners of property abutting the <br />improved portions of River Avenue, including the wastewater treatment plant. If the WPCF site is <br />transferred to MWMC at this time, the City will pay MWMC for the additional right-of-way needed for <br />the project on the south side of River Avenue, and MWMC will then be assessed for its proportionate <br />share of the project costs as the clear owner of the treatment plant property. <br /> <br />The MWMC has programmed the anticipated assessment charges into future expenditures and the <br />transfer of road right-of-way in the future improvement planning. The project has allocated the expense <br />of right-of-way into the project budget. If the council authorizes the transfer of the property to MWMC, <br />the dedication of street right-of-way would occur immediately thereafter. Additionally, the City will <br />retain easements for City facilities on the regional treatment plant site, such as the bike path system and <br />the local River Avenue pump station. <br /> <br />RELATED CITY POLICIES <br />The Eugene Code states "the council may dispose of real property to any governmental entity without <br />hearing or notice" (EC 2.868). <br /> <br />COUNCIL OPTIONS <br />The council may: <br />1. Approve the transfer of95.56 acres of property to the Metropolitan Wastewater Management <br />Commission (MWMC) by Bargain and Sale Deed, contingent upon MWMC's agreement to convey <br />to the City the right-of-way needed to complete the improvements abutting the MWMC site on River <br />Avenue, or <br />2. Direct staff to modify the property transfer to the MWMC. <br /> <br />CITY MANAGER'S RECOMMENDATION <br />The City Manager recommends that the council approve the transfer of approximately 95.56 acres of <br />property to the MWMC contingent upon MWMC simultaneously executing street deeds and easements <br />conveying the right-of-way and easement right needed for the River Avenue Improvement Project. <br /> <br />LICMOl2006 Council Agendas1M0606261S0606263D.doc <br />
