In response to a follow-up question from Councilor Kelly, Ms. Keppler said the manual dictated that <br />closing an existing open drainage system would require further capacity of the entire basin to be con- <br />structed. She added that the manual explained what a person would have to do to design that system. <br /> <br />Councilor Bettman wished to clarify that the ordinance enabled the administrative order. <br /> <br />Councilor Kelly asked that the issue regarding exemption be clarified. He noted that one person testified <br />that Portland had an exemption of 500 square feet. He requested information on why Eugene’s exemption <br />was “so much higher.” <br /> <br />Councilor Kelly also expressed concern that a large subdivision of single-family homes built in an existing <br />PUD would be exempted from the stormwater ordinance. He wished to see language that would close the <br />“big loophole.” <br /> <br />Mayor Piercy called for the vote. <br /> <br />Roll call vote; the vote on the motion was a 4:4 tie; councilors Papé, Bettman, Pryor, and <br />Ortiz voting in favor and councilors Solomon, Taylor, Kelly, and Poling voting in opposi- <br />tion. Mayor Piercy voted against the motion and the motion failed on a final vote of 5:4. <br /> <br />Mr. Klein noted that the two motions had been combined and the request to keep the record open had been <br />denied. <br /> <br />Councilor Kelly, seconded by Councilor Taylor, moved to keep the record open for further <br />written testimony until 5 p.m. on May 22. Roll call vote; the motion passed unanimously, <br />8:0. <br /> <br />Mayor Piercy expressed concern regarding the time. <br /> <br />Councilor Pryor requested that the council address Agenda Item 8 and defer Agenda Item 9, action on the <br />Parks Recreation and Open Space project and priority plan, and work to “triage” the items pulled from the <br />Consent Calendar. <br /> <br />Mayor Piercy conveyed her support for addressing the two Consent Calendar items related to EWEB. <br /> <br />Councilor Pryor, seconded by Councilor Kelly, moved to extend the meeting time by 20 <br />minutes. Roll call vote; the motion passed unanimously, 8:0. <br /> <br /> <br />8. PUBLIC HEARING: <br /> <br />An Ordinance Establishing Local Criteria in the West Eugene Enterprise Zone and Adopting a <br />Public Benefit Scoring System; Repealing Resolution 4851; and Providing an Effective Date <br /> <br />Mayor Piercy opened the public hearing. <br /> <br />th <br />Bob Cassidy <br />, 1401 East 27 Avenue, lauded the committee for doing an excellent job on development of <br />the local criteria. He felt the committee had made the plan better.
