of right-of-way into the project budget. If the council authorizes the transfer of the property to MWMC, the dedication of street right-of-way would occur immediately thereafter. Additionally, the City will retain easements for City facilities on the regional treatment plant site such as the bike path system and the local River Avenue pump station. RELATED CITY POLICIES The Eugene Code states "the council may dispose of real property to any governmental entity without hearing or notice" (EC 2.868). COUNCIL OPTIONS The City Council may: 1. Approve the transfer of95.56 acres of property to the Metropolitan Wastewater Management Commission (MWMC) by Bargain and Sale Deed, contingent upon MWMC's agreement to convey to the City the right-of-way needed to complete the improvements abutting the MWMC site on River Avenue as well as easements necessary to support and maintain the bike path network within the Willamette greenway; or 2. Approve the transfer of95.56 acres of property to the Metropolitan Wastewater Management Commission (MWMC) by Bargain and Sale Deed, contingent upon MWMC's agreement to convey to the City the right-of-way needed to complete the improvements abutting the MWMC site on River Avenue and contingent upon the transfer of property by the City of Springfield to the MWMC consistent with the intergovernmental agreement; or 3. Approve the transfer of approximately 1.5 acres of property associated with the River Avenue Transportation Improvement project to the Metropolitan Wastewater Management Commission (MWMC) by Bargain and Sale Deed, contingent upon MWMC' s agreement to convey to the City the right-of-way needed to complete the improvements abutting the MWMC site on River Avenue; or 4. Re-open the intergovernmental agreement for the Metropolitan Wastewater Management Commission and seek agreement with the other parties to the agreement to change the commitments related to the transfer of property. 5. Direct staff to modify the property transfer to the MWMC. CITY MANAGER'S RECOMMENDATION The City Manager recommends that the council approve the transfer of approximately 95.56 acres of property to the MWMC consistent with the Restated and Amended Agreement for the Metropolitan Wastewater Management Commission and contingent upon the MWMC simultaneously executing street deeds and easements conveying the right-of-way and easement rights needed for the River Avenue Improvement Project. SUGGESTED MOTION Move to direct the City Manager to take the necessary steps to proceed with the transfer of approximately 95.56 acres of City owned land to the Metropolitan Wastewater Management Commission, contingent upon MWMC's agreement to convey to the City the right-of-way needed to complete the improvements abutting the MWMC site on River Avenue.
