<br />of right-of-way into the project budget. If the council authorizes the transfer of the property to MWMC, <br />the dedication of street right-of-way would occur immediately thereafter. Additionally, the City will <br />retain easements for City facilities on the regional treatment plant site such as the bike path system and <br />the local River Avenue pump station. <br /> <br />RELATED CITY POLICIES <br />The Eugene Code states "the council may dispose of real property to any governmental entity without <br />hearing or notice" (EC 2.868). <br /> <br />COUNCIL OPTIONS <br />The City Council may: <br />1. Approve the transfer of95.56 acres of property to the Metropolitan Wastewater Management <br />Commission (MWMC) by Bargain and Sale Deed, contingent upon MWMC's agreement to convey <br />to the City the right-of-way needed to complete the improvements abutting the MWMC site on River <br />Avenue as well as easements necessary to support and maintain the bike path network within the <br />Willamette greenway; or <br />2. Approve the transfer of95.56 acres of property to the Metropolitan Wastewater Management <br />Commission (MWMC) by Bargain and Sale Deed, contingent upon MWMC's agreement to convey <br />to the City the right-of-way needed to complete the improvements abutting the MWMC site on River <br />Avenue and contingent upon the transfer of property by the City of Springfield to the MWMC <br />consistent with the intergovernmental agreement; or <br />3. Approve the transfer of approximately 1.5 acres of property associated with the River Avenue <br />Transportation Improvement project to the Metropolitan Wastewater Management Commission <br />(MWMC) by Bargain and Sale Deed, contingent upon MWMC' s agreement to convey to the City the <br />right-of-way needed to complete the improvements abutting the MWMC site on River Avenue; or <br />4. Re-open the intergovernmental agreement for the Metropolitan Wastewater Management <br />Commission and seek agreement with the other parties to the agreement to change the commitments <br />related to the transfer of property. <br />5. Direct staff to modify the property transfer to the MWMC. <br /> <br />CITY MANAGER'S RECOMMENDATION <br />The City Manager recommends that the council approve the transfer of approximately 95.56 acres of <br />property to the MWMC consistent with the Restated and Amended Agreement for the Metropolitan <br />Wastewater Management Commission and contingent upon the MWMC simultaneously executing street <br />deeds and easements conveying the right-of-way and easement rights needed for the River Avenue <br />Improvement Project. <br /> <br />SUGGESTED MOTION <br />Move to direct the City Manager to take the necessary steps to proceed with the transfer of <br />approximately 95.56 acres of City owned land to the Metropolitan Wastewater Management <br />Commission, contingent upon MWMC's agreement to convey to the City the right-of-way needed to <br />complete the improvements abutting the MWMC site on River Avenue. <br /> <br />LICMOl2006 Council Agendas1M0607101S0607104.doc <br />
