Sites that were formerly within the planned alignment were re- <br />evaluated under the new wetland designation criteria and several are <br />recommended to be re-designated from Development to Protection (amendments <br />numbered 1, 6 (portion), 7, 8 (portion) and 9). <br /> <br />Section 9.14S (2)( c)3. "Incorporation into the plan of new inventory material which relates <br />to a statewide goal; or" <br /> <br />Findings: <br /> <br />The incorporation of new wetland sites into the plan (amendments numbered 9, <br />10, 11, 20, 21, 24, 25, 26, 27, 27a, 28, 29, 30, 31, 32, 33, 34, 35, 36, 38 ,39, 39a, <br />40,41,42, 42a, 43, 44, 45, 47a, 49, 50,51,53,54, 55, 56, 57, 58 and 59) is an <br />incorporation of new inventory material which relates to statewide Goal 5. In the <br />case of the West Eugene Wetlands Plan the Goal 5 ESEE analysis requirement is <br />met through the approval process for a state-sanctioned Wetland Conservation <br />Plan as provided for in ORS 196.684(8). <br /> <br />Conclusions: The proposed amendments listed above meet this criterion. <br /> <br />Section 9.14S (2)(c) 4. "A change in public policy." <br /> <br />Findings: <br /> <br />Proposed amendments numbered 1,6,9,17,18,19,22,37,38,41 and 51 involve <br />designating all or a portion of a wetland site for "Planned Transportation <br />Corridor". The "Planned Transportation Corridor" is a new Plan designation <br />adopted in amendments approved by Eugene and Lane County in 1999. This <br />designation is considered a "conservation" designation under state rules, which <br />allows more uses than would be allowed within a wetland designated for <br />Protection. These amendments respond to recent changes in the Oregon <br />Administrative Rules which govern the Oregon Division of State Lands <br />administration of the state's wetland regulatory system. These state rule changes, <br />approved after adoption of the Plan in 1992, included provisions for allowing <br />"utilities and transportation facilities not built, but specifically identified in the <br />acknowledged local comprehensive plan" within otherwise protected areas (OAR <br />141-120-030(2) and 141-120-130(2)(a)). The amendments listed above, made <br />possible by the changes to OAR, ensure consistency between the Plan designation <br />and policy contained in TransPlan, a refinement plan to the Metro Plan. <br /> <br />Following adoption of the Plan in 1992, new state rules were adopted governing <br />wetlands designated for Protection in an adopted Wetland Conservation Plan. <br />The West Eugene Wetlands Plan is the only approved Wetland Conservation Plan <br />in Oregon. The new state rules specified the activities allowed within Protected <br />wetlands, and raised uncertainty about whether certain maintenance or repair <br />activities on existing utilities would be allowed. In order to address this conflict, <br />/ a new policy was adopted to establish a special designation for existing utilities <br />/ within protected wetlands, which is called Utility Corridor.
