<br />4.996 Administrative Civil Penalty. <br />(1) In addition to, and not in lieu of any other enforcement mechanism authorized <br />by this code the city manager or designee may impose upon the person responsible for violation of <br />subsection (1) of section 4.050 of this code, an administrative civil penalty as provided by section <br />2.018 of this code. For purposes of this subsection, there is a rebuttable presumption that a person <br />responsible includes those persons referenced in subsections 4.050(4)(a)-(t). <br />(2) Notwithstanding the appeal procedures of sections 2.018 and 2.021 of this <br />code, an individual presumed responsible under subsection 4.050(4) for payment of an administrative <br />civil penalty may appeal the imposition of the administrative civil penalty within 10 days of the date <br />of the civil penalty is imposed. The individual presumed responsible shall submit with the notice <br />of appeal to the city manager or designee a written declaration made under penalty of perjury or a <br />sworn affidavit that the person did not cause, authorize, or permit the posting of material in violation <br />of subsection 4.050(1). A notice of appeal that does not contain such a declaration shall be <br />dismissed. <br />(3) In addition to enforcement mechanisms authorized elsewhere in this code, <br />failure to pay an administrative civil penalty imposed pursuant to this section constitutes a violation <br />of this code. <br /> <br />Section 4. The City Recorder, at the request of, or with the concurrence of the City Attorney, <br /> <br />is authorized to administratively correct any reference errors contained herein or in other provisions <br /> <br />of the Eugene Code, 1971, to the provisions added, amended or repealed herein. <br /> <br />Passed by the City Council this <br /> <br />Approved by the Mayor this <br /> <br />22nd day of January, 2001 <br /> <br /> <br />Mayor <br /> <br />$~-1-1 / :E;4~ <br /> <br />City Recorder <br /> <br />Ordinance - 3 <br />
