HANSEN Alissa H <br />From:Paul Conte <paul.t.conte@gmail.com> <br />Sent:Friday, January 06, 2017 1:40 PM <br />To:HANSEN Alissa H <br />Cc:*Eugene Mayor, City Council, and City Manager <br />Subject:Potential deficiency in Measure 49 Public Hearing notice <br />Alissa, <br />I may be mistaken, but it appears that the Public Notice of the January 17, 2017 Public Hearing on <br />the "Wilson M49 Claim" may not have provided a mandatory item required by the statutes. <br />ORS 195.314(2)(a) requires the notice to include " the final date for submission of written evidence <br />and arguments relating to the claim." <br />While a person who has read all of ORS 195.314 may be able to understand the deadline, I don't see <br />that the notice itself provides sufficient information. <br />Given the City's poor track record on procedural issues, you may want to consider re-scheduling and <br />re-noticing the hearing to avoid an appeal based on an error that prejudices the rights of <br />interested parties. <br />-- Paul <br />_________________ <br />1 <br /> <br />
