To:Mayor,CityCouncilandCityManager <br />From:BillAspegren <br />th <br />Subject:TestimonyregardingtheźƌƭƚƓƭMeasure49Claimat1777E.30Avenue <br />th <br />TheWilsonsownpropertyat1777E.30Avenue.Theyclaimtheycannotbuildahouseontheir <br />propertyandatthesametimeconvertthecurrentlyexistingstructureintoaSecondaryDwellingUnit <br />(SDU).TheybelievethisisbecausetheR1codechanges,inordinancenumber20526,effectiveApril12, <br />2014,specificallyEC9.2751(17)(c)9,SDUheight/setbackchanges,nolongerallowedtheexisting <br />structuretoqualifyasaSDU.Becauseofthesechanges,theirpropertylost$60,000invalueandthey <br />havefiledaMeasure49claim,askingforaheight/setbackexemptionratherthanmonetary <br />compensation. <br />Itismycontentiontheclaimhasnomeritandshouldberejected.Thisconclusionisbasedonthe <br />followingpoints,whichIwillexpandonaspartofthistestimony: <br />th <br />Noevidencewaspresentedthatthestructureat1777E.30Avenuecouldhavebeenalegal <br />SDUpriortoApril12,2014.IbelieveitcouldnothavequalifiedasaSDUwhenitwasbuilt,by <br />theWilsons,in2004oranytimebetweenthenandtheeffectivedateoftheR1changes. <br />ptionthattheexisting <br />Thehypotheticalappraisalswerebasedontheincorrectassum <br />structurecouldhavebeenalegalSDUpriortoApril12,2014.Theappraisalsdidnotanalyze <br />theeffectofthehousingcrisis,recession,foreclosuresandpartialrecoveryoftheoverallmarket <br />onhomeprices.NoevidencewaspresentedthattheR1changesrestrictedtheźƌƭƚƓƭ <br />residentialuseoftheproperty. <br />TheCityCouncilunanimouslyapprovedtheR1changesMarch12,2014,afterunanimousapprovalby <br />thePlanningCommission.TheCouncilshouldbecautiousaboutgrantingexceptions,withoutconclusive <br />evidence,therebysettingaveryconcerningprecedentthatwillhaveconsequenceswellbeyondtheR1 <br />changes. <br />DidtheexistingstructureeverqualifyasaSDU? <br />th <br />Thestructureat1777E.30Avenuewaspermitted(040122301)andbuiltin2004.Itresidesonthe <br />southportionofa.64acrelotthatisbisectedbyaprivateaccessroad.TheCitynolongerhadoriginal <br />plansforthebuilding,describedinthepermitasaͻbĻǞƭŷƚƦΉŷƚƒĻͼ͵However,Ididobtaintwo <br />drawingsofthestructuredatedJune15,2014.Theseweresubmittedaspartofpermit(140338001) <br />foranewsinglefamilyhometobebuiltonthenorthportionofthelotandconversionoftheexisting <br />structuretoaSDU.Thepermitwasneverissued. <br />TheCityreceivedtherequestforanewhomeJune16,2014,twomonthsaftertheR1changesbecame <br />effective.AtthattimetheexistingstructurewasnotclassifiedasaSDU,anddidnotqualifyasaSDU <br />underthecodechanges.ThequestionisdidthebuildingqualifyasaSDUbeforeordinancenumber <br />20526becameeffective?Ifitdidnot,thereisnobasisforaMeasure49claim. <br />βЊβ <br /> <br />
