<br />Section 1. The following fees are hereby established as the fees to be paid, on or before May <br />1, 1998, by hazardous substance users within the City of Eugene, as defined by Amendment IV to <br />the Eugene Charter of 1976: <br /> <br />$500 per hazardous substance user; plus <br />$16.28 per employee of each hazardous substance user. In the event that additional <br />hazard substance users are identified before individual fees are calculated, this figure <br />may be revised downward. <br /> <br />Section 2. The fees collected pursuant to this Resolution shall be used solely for the purpose <br />of operating the Toxics Right-to-Know Program created by Amendment IV to the Eugene Charter <br />of 1976 for the fiscal year beginning July 1, 1998, and ending June 30, 1999. <br /> <br />Section 3. The Council finds that these fees should be established on the basis of information <br />contained in materials balance reports, which are unavailable at this time. The Council therefore <br />recommends that: (a) the fee structure established by this resolution be adjusted, and the 1999 fees <br />be calculated, on the basis of information contained in materials balance reports submitted as of <br />April 1 , 1999; and (b) the 1999 fees include an adjustment based on a retrospective look at the 1998 <br />fees. <br /> <br />The foregoing Resolution adopted the 16th day of March, 1998. <br /> <br /> <br />Resolution - 2 <br />
