<br />RESOLUTION NO. 4673 <br /> <br />A RESOLUTION OF THE CITY OF EUGENE, LANE <br />COUNTY, OREGON, CALLING A SPECIAL ELECTION TO <br />SUBMIT A MEASURE TO THE VOTERS OF THE CITY ON <br />REOPENING BROADWAY, BETWEEN THE EAST MARGIN <br />OF CHARNEL TON STREET TO THE WEST MARGIN OF <br />OAK STREET, TO VEHICULAR TRAFFIC. <br /> <br />The City Council of the City of Eugene finds as follows: <br /> <br />1. The City has authority under the Eugene Charter of 1976, the Oregon Constitution, <br />and the Eugene Code, 1971, to submit measures to the electorate of the City. <br /> <br />2. Except for its intersections with Willamette Street and Olive Street, Broadway, <br />between the East margin of Chamelton Street and the West margin of Oak Street, is closed to <br />vehicular traffic. Section 2 of Amendment III of the Eugene Charter of 1976 requires that this <br />portion of Broadway remain closed to vehicular traffic unless the electors of the City, at a primary <br />election, a general election, or at a special election held between Labor Day of one year and <br />Memorial Day of the following year, vote to approve reopening the street. <br /> <br />3. Broadway between the East margin of Chamelton Street and the West margin of Oak <br />Street, should be reopened, but only if the electors of the City approve the re-opening. <br /> <br />4. The City Council therefore desires to place a measure before the voters, that asks <br />whether Broadway between the East margin of Charnelton Street and the West margin of Oak Street <br />should be reopened to vehicular traffic. <br /> <br />NOW, THEREFORE, based upon the above findings, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br /> <br />Section 1. A special election is called for the purpose of submitting to the qualified voters <br />of the City the question of whether to reopen Broadway between the East margin of Chamelton <br />Street and the West margin of Oak Street to vehicular traffic, subject to available funding. <br /> <br />Section 2. The City Council orders this special election to be held in the City of Eugene, <br />Oregon on the 18th day of September, 2001, in accordance with the provisions of Chapter 254 of <br />Oregon Revised Statutes, and the ballots shall be counted and tabulated and the results certified as <br />provided by law. <br /> <br />Resolution - 1 <br />
